If a former employee receiving benefits engages in any form of employment or <br />performs any compensable work, whether as an employee or as an independent <br />contractor, or receives outside income (either direcfiy or indirectly) from a trade or <br />business while he or she is receiving disability benefits under this Article, then the <br />benefits payable to such person under this Article shall be adjusted so that when the <br />sum of the benefits under the Article is exceeded by earnings from such work and/or <br />trade or business and any other earned income received (either direcfiy or indirectly - <br />excluding that properly atu'ibuted to a spouse) by the employee under this Article <br />during any 3 month period (a) in the case of an employee whose benefits under this <br />Article commence on or before June 30, 1995, by twice the amount of current base <br />pay during such period, or (b) in the case of an employee whose benefits under this <br />Article commence on or after July 1, 1995, the amount of current base pay during <br />such period, the benefit under this Article shall be reduced by $.50 for each $1.00 of <br />excess. Current base pay shall be determined with reference to the position held by <br />the person at the time he or she was determined to be disabled. Any person receiving <br />disability benefits shall be required to report to the Board at intervals, when requested <br />by the Board, and give full details with reference to their employment.
