BILL NO. 8293 INTRODUCED BY COUNCILMEMBER WARE ORDINANCE NO. 6O75 AN ORDINANCE GRANTING, SELLING AND CONVEYING TO THE METROPOLITAN ST. LOUIS SEWER DISTRICT A SUBTERRANEAN CYLINDRICAL EASEMENT IN LOTS 28, 29 AND 30 OF BLOCK 7 OF NORTH PARKVIEW SUBDIVISION AND PART OF BLOCK 3 OF ROSEDALE SUBDIVISION IN UNIVERSITY CITY, MISSOURI. WHEREAS, the Metropolitan St. Louis Sewer District desires to construct and maintain a tunnel located underground within property owned by the City of University City, Missouri; and WHEREAS, the Metropolitan St. Louis Sewer District desires to construct and maintain a sewer line or lines in the tunnel; and WHEREAS, the Metropolitan St. Louis Sewer District has requested a subterranean cylindrical easement in the property for said purposes; and WHEREAS, the easement will further the preservation of the health, safety, morals and general welfare of the people of the City of University City; and WHEREAS, the City of University City is willing to grant, sell and convey the requested easement to the Metropolitan St. Louis Sewer District. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSI'I'Y CITY, MISSOURI, AS FOLLOWS: Section 1. The.City of University City, Missouri is the owner of property described as follows: Lots 28, 29 and 30 of Block 7 of Nodh Parkview Subdivision, Plat Book 11, Page 4, and Part of Block 3 of Rosedale Subdivision in Plat Book 12, Page 74, (City of St. Louis Records) in University City, St. Louis County, Missouri. Section ?. In consideration for the sum of one dollar ($1.00) and other valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the City of University City hereby grants, sells and conveys a subterranean cylindrical easement in said property to the Metropolitan St. Louis Sewer District, subject to the terms and conditions set forth in the 'Subterranean Cylindrical Easement Agreement" marked 'Exhibit 1" and made a part hereof. Section 3. The City Manager of the City of University City, Missouri is hereby - authorized and directed to enter into and execute said Subterranean Cylindrical Easement Agreement on behalf of the City of University City, Missouri.
