BILL NO. <br /> <br />8294 <br /> <br />INTRODUCED BY COUNCILMEMBERMUNKEL <br /> <br /> ORDINANCE NO. <br /> <br />6076 <br /> <br />AN ORDINANCE GRANTING, SELLING AND CONVEYING TO <br />THE METROPOLITAN ST. LOUIS SEWER DISTRICT A <br />SUBTERRANEAN CYLINDRICAL EASEMENT IN LOTS 32 AND 33 <br />OF BLOCK 7 OF NORTH PARKVIEW SUBDIVISION AND PART OF <br />BLOCK 3 OF ROSEDALE SUBDIVISION IN UNIVERSITY CITY, <br />MISSOURI. <br /> <br /> WHEREAS, the Metropolitan St. Louis Sewer District desires to construct and <br />maintain a tunnel located underground within property owned by the City of <br />University City, Missouri; and <br /> <br /> WHEREAS, the Metropolitan St. Louis Sewer District desires to construct and <br />maintain a sewer line or lines in the tunnel; and <br /> <br /> WHEREAS, the Metropolitan St. Louis Sewer District has requested a <br />subterranean cylindrical easement in the property for said purposes; and <br /> <br /> WHEREAS, the easement will further the preservation of the health, safety, <br />morals and general welfare of the people of the City of University City; and <br /> <br /> WHEREAS, the City of University City is willing to grant, sell and convey the <br />requested easement to the Metropolitan St. Louis Sewer District. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY <br />CITY, MISSOURI, AS FOLLOWS: <br /> <br /> Section 1. The City of University City, Missouri is the owner of property described <br />as follows: <br /> <br />Lots 32 and 33 of Block 7 of North Parkview Subdivision, Plat Book 11, <br />Page 4, and Part of Block 3 of Rosedale Subdivision in Plat Book 12, Page <br />74, (City of St. Louis Records) in University City, St. Louis County, Missouri. <br /> <br /> ~. In consideration for the sum of one dollar ($1.00) and other valuable <br />consideration, the receipt and sufficiency of which is hereby acknowledged, the City <br />of University City hereby grants, sells and conveys a subterranean cylindrical <br />easement in said property to the Metropolitan St. Louis Sewer District, subject to the <br />terms and conditions set forth in the 'Subterranean Cylindrical Easement Agreement' <br />marked "Exhibit 1" and made a part hereof. <br /> <br /> Section 3. '[he City Manager of the City of University City, Missouri is hereby <br />- authorized and directed to enter into and execute said Subterranean Cylindrical <br /> Easement Agreement on behalf of the City of University City, Missouri. <br /> <br /> <br />
