BILL NO. INTRODUCED BY COUNCILMEMBER SCHOOMER 8295 ORDINANCE NO. 6077 AN ORDINANCE AMENDING ORDINANCE NO. 6067 RELATING TO THE PROPOSED TRANSFER OF A NON-EXCLUSIVE CABLE TELEVISION FRANCHISE FROM CONTINENTAL CABLEVISION OF ST. LOUIS COUNTY TO TCI CABLE PARTNERS OF ST. LOUIS L.P., BY REPEALING SECTION 1 THEREOF AND ENACTING IN LIEU THEREOF A NEW SECTION 1 ACKNOWLEDGING RECEIPT OF CERTAIN REQUIRED INFORMATION RELATING TO SAID TRANSFERAND GRANTING CONSENT TO SAID TRANSFER. WHEREAS, on August 19, 1996 the City of University City adopted Ordinance No. 6067 (the "Ordinance") which required as a condition for consent to a proposed transfer of a non-exclusive cable television franchise from Continental Cablevision of St. Louis County, a Delaware corporation ("Continental") to TCI Cable Partners of St. Louis, L.P., a Colorado Limited Partnership ("TCICP") the submittal by September 9, 1996 of a supplement to the application for consent to the transfer in the form of Exhibit A to the Ordinance; and WHEREAS, the City has received the required supplement and now wishes to eliminate the requirement for submittal by September 9, 1996 and to grant consent to the proposed transfer by repealing Section 1 of the Ordinance and by substituting a new Section 1; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, MISSOURI, A~S FOLLOWS: Section 1. Ordinance No. 6067 is hereby amended by repealing Section 1 thereof in its entirety and by enacting in lieu thereof a new Section 1 as follows: "Section 1. CONSENT TO TRANSFER. Subject to the conditions set for herein, the City hereby grants its consent to the transfer of the franchise from Continental to TCICP and the assumption by TCICP of the obligations of Continental under the franchise which accrue on and after the date of closing of the transfer. Th~ City acknowledges receipt of and hereby approves an Agreement Supplementing Application for Franchise Authority Consent to Assignment of Cable Television Franchise signed by all companies named in Exhibit A hereto. Except as stated herein, the terms and conditions of the franchise shall continue in full force and effect. The City hereby waives any right to acquire the assets of cable system which the city may have under the franchise as a result of the franchise transfer."
