BILL NO. <br /> <br /> INTRODUCED BY COUNCILMEMBER THOMPSON <br /> <br />8296 ORDINANCE NO. <br /> <br />6078 <br /> <br />AN ORDINANCE AMENDING CHAPTER 34 OF THE MUNICIPAL CODE OF <br />THE CITY OF UNIVERSITY CITY RELATING TO ZONING BY <br />REPEALING SECTION 34-38.4 THEREOF, RELATING TO <br />CONDITIONAL USES IN THE IC - INDUSTRIAL COMMERCIAL <br />DISTRICT, AND ENACTING IN LIEU THEREOF A NEW SECTION TO <br />BE KNOWN AS "SECTION 34-38.4 CONDITIONAL USES," BY ADDING <br />CHILD DAY CARE CENTER OR DAY NURSERY; CONTAINING A SAVING <br />CLAUSE AND PROVIDING A PENALTY. <br /> <br /> WHEREAS, Chapter 34 of the Municipal Code of the City of <br />University City (University City Zoning Code) divides the City into <br />several zoning districts, and regulates the uses to which the <br />premises located therein may be put; and <br /> <br /> WHEREAS, Section 34-38.4 provides for "Conditional Uses" in <br />the "IC" - Industrial Commercial District; and <br /> <br /> WHEREAS, the City Plan Commission in a meeting held at the <br />City Hall on August 28, 1996, at 7:30 p.m. recommended an amendment <br />of Section 34-38.4 of the University City Zoning Code by adding <br />"Child day care center or nursery" as a a conditional use in the <br />"IC" - Industrial Commercial District to Section 34-38.4; and <br /> <br /> WHEREAS, due notice of a public hearing to be held by the City <br />Council in the City Council Chambers at city Hall at 7:30 p.m., <br />September 30, 1996, was duly published in the St. Louis Countian, <br />a newspaper of general circulation within said city on September <br />12, 1996; and <br /> <br /> WHEREAS, said public hearing was held at the time and place <br />specified in said notice, and all suggestions or objections <br />concerning said amendment were duly heard and considered by the <br />council; <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />UNIVERSITY CITY, MISSOURI, AS FOLLOWS: <br /> <br /> Section 1. Chapter 34 of the Municipal Code of the City of <br />University City, Missouri, relating to zoning is hereby amended by <br />repealing Section 34-38.4 thereof, relating to Conditional Uses in <br />the "IC" - Industrial Commercial District, and enacting in lieu <br />thereof a new section to be known as "Section 34-34-38.4, <br />Conditional Uses", relating to the same subject, and re-enacting <br />said section so that said section, as so amended, shall read as <br />follows: <br /> <br />34-38.4. Conditional uses. <br /> <br />The Council, by Conditional Use permit, as provided in Section <br />34-65, after public hearing before the Plan Commission and <br />subject to such protective restrictions and conditions that <br />the Council may deem necessary, may authorize any of the <br /> <br /> <br />
