BILL NO. 8313 INTRODUCED BY CO~NCIL~EMBER SCHOOMER ORDINANCE NO. AN ORDINANCE APPROVING A SALE AGREEMENT FOR THE PUI'~::HASE OF 7719-21 OLIVE; AND AUTHORIZING THE CITY MANAGER TO EXECUTE SAME ON BEHALF OF THE CITY OF UNIVERSITY CITY AND TO TAKE SUCH OTHER ACTION NECESSARY IN CONNECTION THEREWITH. 6095 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF UNIVERSITY CITY, ST. LOUIS COUNTY, MISSOURI as follows: Section 1. A certain Sale Agreement between William H. Ridings and Marilyn Ridings (the "Ridings") and the City of University City, Missouri in the form attached hereto as Exhibit A and incorporated herein by this reference, for the sale by the Ridings and the purchase by the City of property generally known as 7719- 21 Olive (the 'Agreement") is hereby approved. Section ?. The City Manager is hereby authorized and directed to execute the Agreement on behalf of the City of University City and to take such steps as the City Manager deems necessary in administrating said Agreement and closing on the sale pursuant thereto, including but not limited to the exercising or waiving of any of the City's contingency rights as contained therein. Section 3. It is hereby found and determined that the approval of the Agreement is necessary and in the interest of the public health, safety, morals and general welfare of the people of the City of University City. Section 4. The portions of this Ordinance shall be severable. In the event that any portion of this Ordinance is found by a court of competent jurisdiction to be invalid, the remaining portions are valid, unless the court finds the valid portions of this Ordinance are so essential and inseparably connected with and dependent upon the void portion that it cannot be presumed that the City Council would have enacted the valid portions without the invalid ones, or unless the court finds that the valid portions standing alone are incomplete and are incapable of being executed in accordance with the legislative intent. Section 5. This Ordinance shall take effect and be in full force and effect from and after its passage by the City Council and approval by the Mayor. PASSED this 2 7th day of January , 1997.
