BILL NO. 8321 <br /> <br />Introduced by Councilmember Munkel <br /> ORDINANCE NO. 6101 <br /> <br />AN ORDINANCE GRANTING, SELLING AND CONVEYING TO THE <br />METROPOLITAN ST. LOUIS SEWER DISTRICT A PERMANENT EASEMENT ON <br />A STRIP OR STRIPS OF GROUND LOCATED BETWEEN VERNON AVENUE <br />AND THE RIVER OF DES PERES CHANNEL, EAST OF PENNSYLVANIA <br />AVENUE; CONTAINING AN EMERGENCY CLAUSE. <br /> <br /> WHEREAS, Schnuck Markets, Inc. desires to construct a shopping center at <br />or near 1000 Pennsylvania Avenue in University City, Missouri; and <br /> <br /> WHEREAS, construction of the shopping center requires the relocation of a <br />sewer line which traverses through the construction site; and <br /> <br /> WHEREAS, the approved routing of the sewer line goes through a portion of <br />property between Vernon Avenue and the River of Des Peres channel, east of <br />Pennsylvania Avenue, that is owned by the City of University City, Missouri; and <br /> <br /> WHEREAS, the Metropolitan St. Louis Sewer District desires to build and <br />maintain said sewer line; and <br /> <br /> WHEREAS, the easement will further the preservation of the health, safety, <br />morals, and general welfare of the people of the City of University City; and <br /> <br /> WHEREAS, the City of University City is willing to grant, sell and convey to the <br />Metropolitan St. Louis Sewer Distdct the requested easement. <br /> <br /> NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY <br />CITY, MISSOURI, AS FOLLOWS: <br /> <br /> Section 1. The City of University City is the owner of certain land between <br />Vernon Avenue and the River of Des Peres channel, east of Pennsylvania Avenue, <br />described as shown hachured on the attached "Easement Plat" marked Exhibit "A" <br />and made a part hereof. <br /> <br /> Section 2. In consideration for the sum of one dollar ($1.00) and other <br />valuable consideration, the receipt and sufficiency of which is hereby <br />acknowledged, the City of University City hereby grants, sells and conveys an <br />easement in said property to the Metropolitan St. Louis Sewer District, subject to the <br />terms and conditions set forth in the "Easement" marked Exhibit "B" and made a <br />part hereof. <br /> <br /> Section 3, The Mayor of the City of University City, Missouri is hereby <br />authorized and direcfed fo enfer info and execute said Easemenf on behalf of fhe <br /> <br /> <br />
