BILL NO. 8324 <br /> <br />INTRODUCED BY COUNCILMEMBER SCHOOMER <br /> <br /> ORDINANCE NO. 6106 <br /> <br />AN ORDINANCE OF THE CITY OF UNIVERSITY CITY, MISSOURI, EXTENDING THE <br />TERM OF FRANCHISE WITH TCI CABLE PARTNERS OF ST. LOUIS, L.P. TO JUNE <br />23, 1999, AND CONTAINING AN EMERGENCY CLAUSE. <br /> <br /> WHEREAS, TCI Cable Partners of St. Louis, L.P., a Colorado limited partnership (TCICP), is the current <br />holder and operator of a non-exclusive cable television franchise granted by the City of University City, Missouri <br />pursuant to a transfer from Continental Cablevision of St. Louis, L.P. (Continental); and <br /> <br /> WHEREAS, Continental and the City properly commenced proceedings during the six month period begming <br />with the 36th month before franchise expiration pursuant to 47 USC § 546 (a) and properly continue to conduct such <br />proceedings with the purpose of considering possible renewal of the franchise; and <br /> <br /> WHEREAS, passage of this Ordinance will not in any way alter the City's powers to continue conducting the <br />proceedings under 47 USC 546 (a) (which proceedings shall not be concluded until the City provides written notice of <br />such conclusion to the holder of the franchise) and otherwise conduct formal and informal franchise renewal proceedings <br />under 47 USC § 546; and <br /> <br /> WHEREAS, the transfer of the franchise caused a delay in completing proceedings under 47 USC § 546 due to <br />the change in operators and personnel, and the City and TCICP have been unable to properly complete negotiations <br />before expiration of the extended franchise and, therefore, an extension of the franchise expiration date to 11:59 p.m. on <br />June 23, 1999, is necessary and in the best interest of the City and its residents; and <br /> <br /> WHEREAS, based upon the foregoing information, representations, and circumstances, the City Council has <br />concluded that it is in the best interest of the City and its residents and businesses to grant consent to extend the term of <br />the franchise subject to certain conditions. <br /> <br /> NOW, THEREFORE, BE IT ORDA1NED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, <br />MISSOURI, AS FOLLOWS: <br /> <br /> Section 1. Extension of Franchise Tenn. The terms of the cable television franchise granted by the City <br />to Continental which was transferred to TCI Cable Partners of St. Louis is hereby extended so as to expire at 11:59 p.m. <br />on June 23, 1999. The continued operation of the cable system by TCICP shall be deemed consent to this extension. <br /> <br /> Section 2. Emergency Clause: Effective Date. This is an emergency ordinance. An emergency exists <br />because the franchise is due to expire before the City's next Council meeting.
