AN ORDINANCEAMENDING CHAPTER 34 OF THE MUNICIPAL CODE OF THE CITY OF UNIVERSITY CITY RELATING TO ZONING BY REPEALING SECTION 34-90, RELATING TO DEFINITIONS, AND ENACTING IN LIEU THEREOF A NEW SECTION TO BE KNOWN AS "SECTION 34-90" BY ADDING THE DEFINITION OF BED AND BREAKFAST FACILITY; CONTAINING A SAVING CLAUSE AND PROVIDING A PENALTY. WHEREAS, Chapter 34 of the Municipal Code of the City of University City (University City Zoning Code) divides the City into several zoning districts, and regulates the uses to which the premises located therein may be put; and WHEREAS, Section 34-90 provides for definitions used in the zoning code; and WHEREAS, the City Plan Commission in a meeting held at the City Hall on March 26, 1997, at 7:30 p.m. recommended an amendment of Section 34-90 of the University City Zoning Code by adding "Bed and Breakfast Facility" to Section 34-90; and WHEREAS, due notice of a public hearing to be held by the City Council in the City Council Chambers at City Hall at 7:30 p.m., June 9, 1997, was duly published in the St. Louis Countian, a newspaper of general circulation within said City on May 17, 1997; and WHEREAS, said public hearing was held at the time and place specified in said notice, and all suggestions or objections concerning said amendment were duly heard and considered by the council; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, MISSOURI, AS FOLLOWS: Section 1. Chapter 34 of the Municipal Code of the City of University City, Missouri, relating to zoning is hereby amended by repealing Section 34-90 thereof, relating to definitions, and enacting in lieu thereof a new section to be known as "Section 34- 90" relating to definitions, and re-enacting said section so that said section, as so amended, shall read as follows: SECTION 34-90 Abutting: Having a common border with, or being separated from such a common border by a right of way or easement for a street, alley, pedestrian way, utilities, or storm water drainage.
