Generally <br /> <br />ARTICLE 1 <br /> <br />GENE 4LLY <br /> <br />SECTION 29-1 TITLE <br /> <br />This Chapter shall be known as and may be cited as the <br />"University City SubdMsion and Land Development <br />Regulations." <br /> <br />SECTION 29-2 INTENT AND PURPOSE <br /> <br />This Clmpter is intended to be utilized in conjunction with <br />Chapter 34, "Zoning" of the Universin.' City Municipal <br />Code to ensure that the development of land within the City <br />occurs in a manner that protects, provides for and promotes <br />the public health, safen.; convenience, comfort, and general <br />welfare of the residents of University City. Specific <br />purposes of this Chapter includes the follo;;Sng: <br /> <br />1. To ensure the or&fly development or redevelopment <br /> of land; <br /> <br />To protect and to conserve the value of buildings and <br />other improvements, and to minimize any adverse <br />impact of development on adjoining or other nearby <br />properties; <br /> <br />To ensure proper legal descriptions and documentation <br />of subdivided land for the protection of both buyers <br />and sellers of land; <br /> <br />To ensure that lot purchasers will receive a buildable, <br />propeft3' oriented lot, provided with adequate facilities <br />to meet day to day needs; <br /> <br />To establish standards of design for subdivision <br />improvements and improvements within unsubdivided ' <br />developments to ensure safe and proper construction of <br />new streets, utilities, drainage facilities; erosion <br />control; and installation of street lighting; <br /> <br />6. To ensure a beneficial relationship between uses of <br /> land and buildings, and the street system, including <br /> <br />safe access and maneuvering of fire trucks and other <br />emergency veh/cles. <br /> <br />To designate and define the powers and duties of the <br />officials administering and enforcing this Chapter; and <br /> <br />8. To estabhsh penalties for the violation of tiffs Chapter. <br /> <br />SECTION 29-3 APPLICABILITY <br /> <br />The provisions of this Chapter shall apply to every <br />subdivision of land as defined herein. The pro~Ssions <br />of this Chapter shall also apply to developments <br />subject to "Planned Development" approval under <br />Section 3440 of Chapter 34, "Zoning." <br /> <br />The improvement plan requirements and land develop- <br />ment standards, as contained in this Chapter, shall also <br />apply to unsubdivided developments, except for <br />construction of improvements on single family and <br />two-family residential lots. <br /> <br />o <br /> <br />Every proposed subdivision of land Mthin the City <br />shall be submitted to the Plan Commission for its <br />report and recommendation thereon to the Cin.' Coun- <br />cil. The final plat of any subdMsion shall not be <br />recorded in the offi~ of the St. Louis Court .ty Recorder <br />of Deeds unless and until the such plat is approved in <br />accordance ~5th the provisions of this Chapter. <br /> <br />The sale or transfer of small parcels of land to or <br />between adjoining propert).' owners, where such sale <br />does not create additional lots, shall comply x{5th the <br />boundary adjustment prox5sions contained in Section <br />29-71 oftNs Chapter without the necessity of comply- <br />ing with the rex-Jew procedures of Article 4 of this <br />Chaptel'. <br /> <br />5. Any court ordered division of a tract of land shall <br /> comply ~aSth the requirements of this Chapter. <br /> <br />SECTION 29-4 VAI. IDITY AND SEV'EILABILITY <br /> <br />It is hereby declared to be the intention of the Cin.' Council <br />that the provisions of tiffs Chapter are severable. If any <br />part of th/s Chapter is declared invalid by any court of <br /> <br />chapt29.fin 1-1 ~ approved by the Plan Cornm~sion on October 22, 1997 <br /> <br /> <br />
