Definitions <br /> <br />wise provide for pedestrian traffic circulation on site. For <br />purposes of this Chapter, pedestrian way does not include <br />"sidewalks." <br /> <br />Plat: A scaled map, plan, or layout of a tract indicating the <br />subdivision of said tract in accordance with the require- <br />ments of this Chapter. <br /> <br />Private street: (see Street, private) <br /> <br />Right-of-way: A strip of land reserved or acquired by <br />dedication, prescription, condemnation, gift, purchase, or <br />any other legal means occupied or intended to be occupied <br />by a street, sidewalk, railroad, ufilit?', sewer, or other <br />similar use. <br /> <br />Setback (building line): The required minimum horizontal <br />distance between the closest point of an exterior wall of a <br />building or any projection thereon and the applicable <br />property line or right-of- wa.v line within which no struc- <br />ture can be placed, unless othervrise provided for in Chap- <br />ter 34, "Zoning." <br /> <br />Side~valk: An improved pathway, located within a street <br />right-of-way or easement along such street, designed to <br />separate pedestrian traffic from veh/cular traffic on such <br />street. <br /> <br />Site: A tract of land upon which actual development exists <br />or development is proposed. <br /> <br />Slope: The inclination from a horizontal reference line of <br />the ground surface, and ex2oressed by stating the horizontal <br />distance relative to the amount of vertical rise or fall (e.g., <br />2 horizontal units to 1 vertical uni0. <br /> <br />Street: A general term denoting a public or private way <br />which affords the principal means of vehicular access to <br />abutting property. The term'includes all facilities which <br />normally are found Mthin a right-of-way. A street may be <br />designation as a hi~wa.v, thoroughfare, parlova.v, through- <br />way, road, avenue, boulevard, lane, place, court or other <br />such terms but shall not include pedestrian way or alley. <br /> <br />Street, collector (non-residentiaO: A street designed to <br />can).' traffic to/from the system of minor streets to/from the <br />s3'stem of major streets; or a street located in any non- <br /> <br />residential zoning district, not including streets under the <br />jurisdiction of MDOT or St. Louis Coun .ty. <br /> <br />Streeg cul-de-sac: A minor residential or non-residential <br />street, one end of which is closed, and consists of a circular <br />turnaround. <br /> <br />Street, minor (residential): A street xvhich principally <br />provides access to residential neighborhood propert/es; <br />carries relatively low traffic volumes which is primarily <br />generated within the immediate residential neighborhood; <br />and is not designed or intended to serve as a collector <br />street. <br /> <br />Street, private: Any street which is privately owned by <br />owners in common (e.g., owners of lots in a subdixSsion <br />development), and is used for vehicular traffic by the <br />owners and those having express or implied permission <br />from the owner. <br /> <br />Subdivision: Any one or more of the following actixSties <br />with respect to land: (a) the division or re-division of a tract <br />of land into two (2) or more lots; or 0o) the creation of a <br />condominium form of ownersh/p of property.; or (c) the <br />consolidation of two (2) or tracts of land into one (i) lot; or <br />(d) the adjustment of one (1) or more boundaries bem,een <br />two (2) or more lots; or (e) the dedication or establishment <br />of a street, alley, easement, or other way for public use in <br />conjunction with use or access to a tract of land. <br /> <br />Subdive'on association: A private, nonprofit association <br />of property. o~,ers that operates and maintains various <br />common propert/es of a subdivision or development. <br /> <br />Subdivision, major: (see Section 29-20.1) <br /> <br />Subdivision, minor: (see Section 29-20.2) <br /> <br />Tract: An area or parcel of land. <br /> <br />Trust indenture: Any recordable instrument by which <br />common ground and improvements are held or maintained <br />or which assessments in a subdix5sion are levied for the <br />administration of specific maintenance obligations or both. <br /> <br />Use: The purpose or activity for which land or a building <br />thereon is designed, arranged or intended, or for which it <br />is maintained. <br /> <br />chapt29.fin 2-3 .&s approved by the Plan Commission on October 22, 1997 <br /> <br /> <br />
