Land Development Standards <br /> <br />(1) <br /> <br />Residential sidewalks or pedestrian ways <br />shall be concrete, having a minimum thick- <br />ness of four (4) inches and increased to six <br />(6) inches at driveway entrances. The mini- <br />mum width of side~valks in residential devel- <br />opments shall be four (4) feet, except that <br />wider widths may be required by the City, <br />Council upon recommendation from the Plan <br />Commission. <br /> <br />(2) <br /> <br />Non-residential sidewalks shall be concrete, <br />having a minimum thickness of four (4) <br />inches and increased to seven (7) inches at <br />driveway entrances. The minimum width of <br />sidewalks in non-residential developments <br />shall be four (4) feet, except that wider widths <br />may be required by the City Council upon <br />recommendation from the Plan Commission. <br /> <br />(3) Sidewalks and pedestrian ways shall be hand- <br /> icapped accessible. <br /> <br />(4) <br /> <br />Where side~valks do not presently exist along <br />the portion of Olive Boulevard that is a State <br />highwa.v, sidewalks shall be provided. How- <br />ever, if the Missouri Department of <br />Transportation prohibits such sidewalks <br />within the State right-of-way, then the side- <br />walks shall be placed in a public easement <br />outside of the right-of-way. <br /> <br />Pedestrian ways, as distinguished from side~valks <br />along streets, may be constructed with other <br />suitable materials. Use of such materials shall be <br />subject to the approval of the Director of Public <br />Works when the developer can demonstrate that: <br /> <br />(1) <br /> <br />Such pedestrian ways would serve the resi- <br />dents of and visitors to the development as <br />adequately as concrete sidewalks; and <br /> <br />(2) <br /> <br />Such pedestrian ways would be more appro- <br />priate with respect to the overall design <br />theme of the development. <br /> <br />2. Sidewalk Variance Procedure: <br /> <br />A developer may request a waiver from the require- <br />ment for sidewalks along a street, in accordance with <br />the variance procedure outlined in Section 29-90, <br />Article 9 of this Chapter. The Zoning Administrator, <br />with the advise of the Director of Public Works shall <br />provide a report to the Plan Commission concerning <br />the conditions within the street right-of-way involved <br />with the request. The Plan Commission may recom- <br />mend and the City Council may approve a waiver in <br />the following cases: <br /> <br />Where sidewalks are not deemed necessary for the <br />public safety or where topographical or other <br />conditions make their installation and use imprac- <br />tical; <br /> <br />Where the applicant has submitted an alternative <br />sidewalk plan that provides for more direct and <br />safer movement of pedestrian traffic; or, <br /> <br />Where the applicant can demonstrate that justifi- <br />able conditions e.,dst wherein the strict application <br />of requirements contained in this section would: <br /> <br />(1) Impose practical difficulties or particular <br /> hardship; or, <br /> <br />(2) Create additional sidewalks that would not be <br /> in the public interest, and public safety would <br /> be adequately accommodated without the <br /> sidewalks. <br /> <br />29-51.4 Lots <br /> <br />1. General: <br /> <br />Every lot shall have access from a public street, <br />except for non-residential lots accessed by a <br />roadway easement or cross-access easement <br />approved by the City Council and recorded on a <br />record or ea_sement plat... · <br /> <br />The minimum area of lots shall be in accordance <br />with the regulations of the zoning district in <br />which the lots are located (see Article 4 of Chap- <br />ter 34, "Zoning"). <br /> <br />chapt29.fin 5-4 As approved by the Plan Commission on October 22, 1997 <br /> <br /> <br />
