<br />AN ORDINANCE CONSENTING TO THE ABROGATION AND RELEASE OF
<br />CERTAIN RESTRICTWE COVENANTS CONTAINED IN A DEED TO 8390
<br />DELMAR BOULEVARD IN UNIVERSITY CITY, MISSOURI, WHICH LIMIT
<br />THE PROPERTY USE TO OFFICES OF DENTISTS, DOCTORS,
<br />OPTOMETRISTS, DRUG STORES (WITHOUT A SODA FOUNTAIN),
<br />STOREROOMS FOR OPTICAL GOODS, OFF-STREET PARKING, MULTIPLE
<br />RESIDENTIAL DWELLINGS, OR RESIDENTIAL OR GENERAL OFFICE
<br />PURPOSES.
<br />
<br /> WHEREAS, Delta Dental Plan of Missouri is the present owner of property located at 8390
<br />Delmar Boulevard in University City, St. Louis County, Missouri, and
<br />
<br /> WHEREAS, by deed recorded on October 20, 1952 in Book 3063, Pages 618 and 619 of the
<br />Office of the Recorder of Deeds of St. Louis County, Missouri, said property was subjected to
<br />certain restrictive covenants enumerated therein, for a period of 20 years from the recording; and
<br />
<br /> WHEREAS, said restrictive covenants limit the use of the property to offices of dentists,
<br />doctors, optometrists, or drag stores (without a soda fountain), storerooms for optical goods, off-
<br />street parking, multiple residential dwellings, or residential or general office purposes; and
<br />
<br /> WHEREAS, after said 20 years the restrictive covenants may be abrogated and released
<br />provided the City Council, with the advice and consent of the City Plan Commission, shall consent
<br />thereto; and
<br />
<br /> WHEREAS, the City Plan Commission in a meeting held at City Hall on November 12,
<br />1997, at 7:30 p.m., gave its consent to the abrogation and release of the restrictive covenants and
<br />advised the City Council to do the same; and
<br />
<br />WHEREAS, said property owner desires the City Council to give its consent.

<br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL THE CITY OF
<br />UNIVERSITY CITY, MISSOURI, AS FOLLOWS:
<br />
<br /> Section 1. The City Council hereby gives its consent to the abrogation and release of the
<br />restrictive covenants contained in the deed recorded on October 20, 1952 in Book 3063, Pages 618
<br />and 619, pertaining to Lot 13 of Delcrest, a subdivision recorded in Plat Book 45, Page 46, of the
<br />Office of the Recorder of Deeds of St. Louis County, Missouri; said property is known as and
<br />numbered 8390 Delmar Boulevard, University City, Missouri.
