AN ORDINANCE GRANTING, SELLING AND CONVEYING TO THE METROPOLITAN ST. LOUIS SEWER DISTRICT A PERMANENT EASEMENT ON A STRIP OF GROUND LOCATED IN THE CENTER OF OAKBROOK LANE FROM DELMAR BOULEVARD TO OAKBROOK COURT. WHEREAS, the Metropolitan St. Louis Sewer District desires to construct and maintain an underground storm sewer within property owned by the City of University City, Missouri; and WHEREAS, said property is located in the center of Oakbrook Lane from Delmar Boulevard to Oakbrook Court; and WHEREAS, the easement will further the preservation of the health, safety, morals, and general welfare of the people of the City of University City; and WHEREAS, the City of University City is willing to grant, sell and convey to the Metropolitan St. Louis Sewer District the requested easement. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, MISSOURI, AS FOLLOWS: Section 1. The City of University City, Missouri, is the owner of certain land located in Oakbrook Lane from Delmar Boulevard to Oakbrook Court described as shown hachured on the attached "Easement Plat" marked Exhibit "A" and made a part hereof. Section 2. In consideration for the sum of one dollar ($1.00) and other valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the City of University City hereby grants, sells 'and conveys an easement in said property to the Metropolitan St. Louis Sewer District, subject to the terms and conditions set forth in the "Easement" marked Exhibit "B" and made a part hereof. Section 3. The City Manager of the City of University City is hereby authorized and directed to enter into and execute on behalf of the City of University City, all documents in connection with said grant, sale and conveyance.
