BILL NO. ~3'~ ORD INAlqCE NO. AN ORDINANCE AMENDING CHAPTER 34 OF THE MUNICIPAL CODE OF THE CITY OF UNIVERSITY CITY, RELATING TO ZONING, BY REPEALING SECTION 34-107 THEREOF, RELATING TO OFF- PREMISES ADVERTISING SIGNS, AND ENACTING IN LIEU THEREOF A NEW SECTION TO BE KNOWN AS "SECTION 34-107. OFF- PREMISES ADVERTISING SIGNS," THEREBY AMENDING SAID SECTION SO AS TO ESTABLISH NEW REGULATIONS ON OFF- PREMISES ADVERTISING SIGNS; CONTAINING A SAVING CLAUSE AND PROVIDING A PENALTY. WHEREAS, Chapter 34 of the Municipal Code of the City of University City (University City Zoning Code) divides the City into several zoning districts, and regulates the uses to which the premises located therein may be put; and WHEREAS, Section 34-107 provides for regulations concerning off-premises advertising signs; and WHEREAS, Section 71.288 RSMo authorizes any city which has the city engineer or similar city official on its planning commission to place any restriction upon the height, spacing and lighting of outdoor advertising structures placed within the view of any highway within such city, and any such ordinance is authorized to be more restrictive than Sections 226.500 to 226.600 RSMo; and WHEREAS, the Plan Commission of the City of University City includes the Director of Planning, a city official similar to a city engineer; and WHEREAS, the City Council has determined that the city ordinance relating to off-premises advertising signs or billboards should be amended so as to establish new regulations; and WHEREAS, the City Plan Commission in a meeting held at the City Hall on January 28, 1998, at 7:30 p.m. recommended an amendment of Section 34-107 of the University City Zoning Code by repealing Section 34-107 thereof, relating to off-premises advertising signs, and enacting in lieu thereof a new section to be known as "Section 34-107. Off-Premises Advertising Signs"; and WHEREAS, due notice of a public hearing to be held by the City Council in the City Council Chambers at City Hall at 7:30 p.m., March 16, 1998, was duly published in the St. Louis Countian, a newspaper of general circulation within said City, on February 27, 1998; and WHEREAS, said public hearing was held at the time and place specified in said notice, and all suggestions or objections concerning said amendment were duly heard and considered by the council.
