BILL NO. <br /> <br />~3'~ ORD INAlqCE NO. <br /> <br />AN ORDINANCE AMENDING CHAPTER 34 OF THE MUNICIPAL CODE OF <br />THE CITY OF UNIVERSITY CITY, RELATING TO ZONING, BY <br />REPEALING SECTION 34-107 THEREOF, RELATING TO OFF- <br />PREMISES ADVERTISING SIGNS, AND ENACTING IN LIEU THEREOF <br />A NEW SECTION TO BE KNOWN AS "SECTION 34-107. OFF- <br />PREMISES ADVERTISING SIGNS," THEREBY AMENDING SAID <br />SECTION SO AS TO ESTABLISH NEW REGULATIONS ON OFF- <br />PREMISES ADVERTISING SIGNS; CONTAINING A SAVING CLAUSE <br />AND PROVIDING A PENALTY. <br /> <br /> WHEREAS, Chapter 34 of the Municipal Code of the City of <br />University City (University City Zoning Code) divides the City into <br />several zoning districts, and regulates the uses to which the <br />premises located therein may be put; and <br /> <br /> WHEREAS, Section 34-107 provides for regulations concerning <br />off-premises advertising signs; and <br /> <br /> WHEREAS, Section 71.288 RSMo authorizes any city which has the <br />city engineer or similar city official on its planning commission <br />to place any restriction upon the height, spacing and lighting of <br />outdoor advertising structures placed within the view of any <br />highway within such city, and any such ordinance is authorized to <br />be more restrictive than Sections 226.500 to 226.600 RSMo; and <br /> <br /> WHEREAS, the Plan Commission of the City of University City <br />includes the Director of Planning, a city official similar to a <br />city engineer; and <br /> <br /> WHEREAS, the City Council has determined that the city <br />ordinance relating to off-premises advertising signs or billboards <br />should be amended so as to establish new regulations; and <br /> <br /> WHEREAS, the City Plan Commission in a meeting held at the <br />City Hall on January 28, 1998, at 7:30 p.m. recommended an <br />amendment of Section 34-107 of the University City Zoning Code by <br />repealing Section 34-107 thereof, relating to off-premises <br />advertising signs, and enacting in lieu thereof a new section to be <br />known as "Section 34-107. Off-Premises Advertising Signs"; and <br /> <br /> WHEREAS, due notice of a public hearing to be held by the City <br />Council in the City Council Chambers at City Hall at 7:30 p.m., <br />March 16, 1998, was duly published in the St. Louis Countian, a <br />newspaper of general circulation within said City, on February 27, <br />1998; and <br /> <br /> WHEREAS, said public hearing was held at the time and place <br />specified in said notice, and all suggestions or objections <br />concerning said amendment were duly heard and considered by the <br />council. <br /> <br /> <br />
