ORDINANCE NO. <br /> <br />AN ORDINANCE AMENDING CHAPTER 34 OF THE MUNICIPAL CODE OF <br />THE CITY OF UNIVERSITY CITY, MISSOURI, RELATING TO ZONING, BY <br />REPEALING SECTION 34-40.16.2(b) THEREOF, RELATING TO PLANNED <br />DEVELOPMENT DISTRICTS - FINAL DEVELOPMENT PLAN PROCEDURE, <br />AND ENACTING IN LIEU THEREOF A NEW SECTION TO BE KNOWN AS <br />SAID REPEALED SECTION WAS KNOWN, THEREBY AMENDING SAID <br />SECTION SO AS TO PROHIBIT ANY MODIFICATION OF A DEVELOPMENT <br />PLAN FROM RESULTING IN AN INCREASE IN BUILDING HEIGHT; <br />CONTAINING A SAVING CLAUSE AND PROVIDING A PENALTY. <br /> <br /> WHEREAS, Chapter 34 of the Municipal Code of the City of University City, Missouri <br />(Zoning Code) divides the City of University City (City) into several zoning districts, and regulates <br />the character of buildings which may be erected in said districts, and the uses to which the buildings <br />and premises located therein may be put; and <br /> <br /> WHEREAS, the City Plan Commission examined an amendment of Section 34-40.16.2(b) <br />thereof prohibiting any modification of a development plan from resulting in an increase in building <br />height; and <br /> <br /> WHEREAS, the Plan Commission, in a meeting held at City Hall on January 28, 1998, at <br />7:30 p.m., approved said amendment of the Zoning Code and recommended to the City Council that <br />it be enacted into an ordinance; and <br /> <br /> WHEREAS, due notice of a public hearing to be held by the City Council in the City Council <br />Chambers at City Hall on March 16, 1998, at 7:30 p.m., was duly published in the St. Louis <br />Countian, a newspaper of general circulation within the City, on February 27, 1998; and <br /> <br /> WHEREAS, said public hearing was held at the time and place specified in said notice, and <br />all suggestions or objections concerning said amendment were duly heard and considered by the City <br />Council. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />UNIVERSITY CITY, MISSOURI, AS FOLLOWS: <br /> <br /> Section 1. Chapter 34 of the Municipal Code of the City of University City, Missouri, <br />relating to zoning, is hereby amended by repealing Section 34-40.16.2(b) thereof, relating to planned <br />development districts - final development plan procedure, and enacting in lieu thereof a new section <br />to be known as said repealed section was known, thereby amending said section so as to prohibit any <br />modification of a development plan from resulting in an increase in building height; so that said <br />section, as so amended, shall read as follows: <br /> <br /> <br />
