so that said section, as so amended, shall read as follows: 34-162.4. City Council Action After holding a public heating on the proposed amendment and before making its final decision, the City Council may refer the application back to the Plan Commission for additional study. In this event, no additional public hearing is required. In case of a protest against such change duly signed and acknowledged by the owners of thirty (30) percent or more, either of the areas of the land ( exclusive of streets and alleys) included in such proposed change or within an area determined by lines drawn parallel to and one hundred and eighty-five (185) feet distant from the boundaries of the district proposed to be changed, such change shall not become effective except by the favorable vote of two-thirds (2/3) of all of the members of the City Council. The petition shall be filed with the City Clerk no later than 5:00 p.m. of the day of the scheduled public heating date. o The Plan Commission may recommend that an application for a map amendment be approved for a part of the property described in the application. The City Council may approve such a partial change to the Official Zoning map. The Plan Commission may recommend and the City Council may approve a zoning district classification other than the classification requested in the map amendment application, provided that the classification is for a similar use type and could accomplish the objectives of the original application. The district classification of the same use type, as referred to in this paragraph, shall include the "PD" Planned Districts when the applicant presents plans and supporting documentation required by Article 4, Section 34-40, prior to or at the public heating on the proposed map amendment. Section 2. This ordinance shall not be construed so as to relieve any person, firm or corporation from any penalty incurred by the violation of Section 34-162.4, nor bar the prosecution of any such violation. Section 3. Any person, firm or corporation violating any of the provisions of this ordinance shall, upon conviction thereof, be subject to the penalties provided in Chapter 34 and in Chapter 1, Section 1-8 of the Municipal Code of the City of University City.
