so that said section, as so amended, shall read as follows: <br /> <br />34-162.4. City Council Action <br /> <br />After holding a public heating on the proposed amendment and before making its <br />final decision, the City Council may refer the application back to the Plan <br />Commission for additional study. In this event, no additional public hearing is <br />required. <br /> <br />In case of a protest against such change duly signed and acknowledged by the owners <br />of thirty (30) percent or more, either of the areas of the land ( exclusive of streets and <br />alleys) included in such proposed change or within an area determined by lines <br />drawn parallel to and one hundred and eighty-five (185) feet distant from the <br />boundaries of the district proposed to be changed, such change shall not become <br />effective except by the favorable vote of two-thirds (2/3) of all of the members of the <br />City Council. The petition shall be filed with the City Clerk no later than 5:00 p.m. <br />of the day of the scheduled public heating date. <br /> <br />o <br /> <br />The Plan Commission may recommend that an application for a map amendment be <br />approved for a part of the property described in the application. The City Council <br />may approve such a partial change to the Official Zoning map. <br /> <br />The Plan Commission may recommend and the City Council may approve a zoning <br />district classification other than the classification requested in the map amendment <br />application, provided that the classification is for a similar use type and could <br />accomplish the objectives of the original application. The district classification of <br />the same use type, as referred to in this paragraph, shall include the "PD" Planned <br />Districts when the applicant presents plans and supporting documentation required <br />by Article 4, Section 34-40, prior to or at the public heating on the proposed map <br />amendment. <br /> <br /> Section 2. This ordinance shall not be construed so as to relieve any person, firm or <br />corporation from any penalty incurred by the violation of Section 34-162.4, nor bar the prosecution <br />of any such violation. <br /> <br /> Section 3. Any person, firm or corporation violating any of the provisions of this <br />ordinance shall, upon conviction thereof, be subject to the penalties provided in Chapter 34 and in <br />Chapter 1, Section 1-8 of the Municipal Code of the City of University City. <br /> <br /> Section 4. <br />provided by law. <br /> <br />This ordinance shall take effect and be in force from and after its passage, as <br /> <br />PASSED this 730 dayof ~~~ , 1998. <br /> <br /> <br />
