BILL NO. ~q~) ORDINANCE NO. b!$~ <br /> <br />AN ORDINANCE AMENDING CHAPTER 23 OF THE MUNICIPAL CODE OF <br />THE CITY OF UNIVERSITY CITY, MISSOURI, RELATING TO OFFENSES- <br />MISCELLANEOUS, BY REPEALING SECTION 23-32.2 THEREOF, RELATING <br />TO STEALING UNDER ONE HUNDRED FIFTY DOLLARS PROHIBITED, <br />AND ENACTING IN LIEU THEREOF NEW SECTIONS TO BE KNOWN AS <br />"SECTION 23-32.2. STEALING," AND "SECTION 23-32.3. RECEIVING <br />STOLEN PROPERTY," AND "SECTION 23-32.4. DEFINITIONS;" THEREBY <br />AMENDING CHAPTER 23 SO AS TO DELETE THE JIJRISDICTIONAL LIMIT <br />FOR STEALING OFFENSES AND CONFORM WITH STATE LAW; <br />CONTAINING A SAVING CLAUSE AND PROVIDING A PENALTY. <br /> <br /> BE IT ORDAiNED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, <br />MISSOURI, AS FOLLOWS: <br /> <br /> Section 1. Chapter 23 of the Municipal Code of the City of University City, Missouri, <br />relating offenses-miscellaneous, is hereby amended by repealing Section 23-32.2 thereof, relating <br />to stealing under one hundred fifty dollars prohibited, and enacting in lieu thereof new sections to <br />be known as "Section 23-32.2. Stealing," and "Section 23-32.3. Receiving stolen property," and <br />"Section 23-32.4. Definitions;" so that said sections, as so amended, shall read as follows: <br /> <br />Section 23-32.2, Stealing. <br /> <br />A person commits the violation of stealing if he or she appropriates property or <br />services of another with the purpose to deprive him or her thereof, either without his <br />or her consent or by means of deceit or coercion. <br /> <br />Evidence of the following is admissible in any prosecution under this section on the <br />issue of the requisite knowledge or belief of the alleged stealer: <br /> <br />That he or she failed or refused to pay for properly or services of a hotel, <br />restaurant, inn or boardinghouse; <br />That he or she gave in payment for properly or services of a hotel, restaurant, <br />inn or boardinghouse a check or negotiable paper on which payment was <br />refused; <br />That he or she left the hotel, restaurant, inn or boardinghouse with the intent <br />to not pay for properly or services; <br />That he or she surreptitiously removed or attempted to remove his or her <br />baggage from a hotel, inn or boardinghouse. <br /> <br />A person who appropriates lost property shall not be deemed to have stolen <br />that property within the meaning of this section unless such property is found <br />under circumstances which gave the finder knowledge of or means of inqui~~ <br /> <br /> <br />
