BILL NO. ~t~)'~ ORDINANCE NO./L0/~ AN ORDINANCE VACATING AND SURRENDERING A UTILITY EASEMENT IN LOT 22 OF BARBY LANE, NEAR ONE MCKNIGHT PLACE, AND DIRECTING THAT THIS ORDINANCE BE RECORDED IN THE OFFICE OF THE RECORDER OF DEEDS OF ST. LOUIS COUNTY, MISSOURI. WHEREAS, there is a utility easement dedicated to the City of University City in Lot 22 of Barby Lane, in University City, in St. Louis County, Missouri; and WHEREAS, the City Plan Commission, in a meeting held at City Hall on October 1, 1998, at 7:30 p.m., approved the vacation of said utility easement and recommended to the City Council that it be done; and WHEREAS, due notice of a public heating to be held by the City Council in the City Council Chambers at City Hall on October 12, 1998, at 7:30 p.m., was duly published in the St. Louis Countian, a newspaper of general circulation within said City, on September 25, 1998; and WHEREAS, said public hearing was held at the time and place specified in said notice, and all suggestions or objections concerning said vacation were duly heard and considered by the City Council. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, MISSOURI, AS FOLLOWS: Section 1. A utility easement dedicated to the City of University City in Lot 22 of Barby Lane, in University City, in St. Louis County, Missouri, and all of University City'~ right, title and interest therein is hereby vacated, surrendered and quitclaimed; said property is more specifically described as follows: A 10' wide utility easement, dedicated to the City of University City, Missouri in Lot 22 of Barby Lane as recorded in Plat Book 61, Page 30, in Section 8, Township 45 North, Range 6 East, in University City, Missouri and being more particularly described as follows: Beginning at the common point of the Southeast comer of the aforesaid Lot 22 of Barby Lane as recorded in Plat Book 61, Page 30 and an angle point in the West line of Lot 1 of One McKnight Place as recorded in Plat Book 261, Page 32; thence along the Southern line of said Lot 22 North 89o34'42" West 66.67 feet to a point at the common Southwest comer of Lot 22 and the Southeast comer of Lot 21 of said Barby Lane; thence along the East line of Lot 21 North 00059'23" East 10 feet thence departing the said East line of Lot 21 of South 89°37'42" East 66.67 feet to a point in the West line of the aforesaid Lot 1 of One McKnight Place; thence along said West line of Lot 1 of One McKnight Place South 00o59'23" West 10.00 feet to the point of beginning and containing 666.7 Square Feet more or less or 0.015 Acres more or less.
