(9~OO <br /> <br />AN ORDINANCE AMENDING CHAPTER 2.64 OF THE UNIVERSITY CITY <br />MUNICIPAL CODE, RELATING TO THE NONUNIFORMED EMPLOYEES <br />RETIREMENT SYSTEM, BY REPEALING SECTION 2.64.120 THEREOF, <br />RELATING TO BENEFITS OTHER THAN ON RETIREMENT, AND <br />ENACTINC IN LIEU THEREOF A NEW SECTION TO BE KNOWN AS <br />"SECTION :!.64.120 BENEFITS OTHER THAN ON RETIREMENT," THEREBY <br />AMENDIN{ ~ SAID SECTION SO AS TO INCREASE THE AMOUNT OF DEATH <br />BENEFITS PAYABLE TO CERTAIN SURVIVORS OF EMPLOYEES WHO DIE <br />ON OR AFT ER THEIR EARLY SERVICE RETIREMENT DATE BUT PRIOR TO <br />THEIR NORMAL SERVICE RETIREMENT DATE AND HAVE <br />ACCUMULATED CONTRIBUTIONS IN AN AMOUNT WHICH IS LESS THAN <br />ONE HUNDRED (100) PERCENT OF THEIR FINAL AVERAGE <br />COMPENSATION. <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, <br />MISSOURI, AS FOLLOWS: <br /> <br /> Section 1. Chapter 2.64 of the University City Municipal Code, relating to the <br />nonuniformed empl)yees retirement system, is hereby amended by repealing Section 2.64.120 <br />thereof, relating to benefits other than on retirement, and enacting in lieu thereof a new section to <br />be known as "Section 2.64.120 Benefits other than on retirement," thereby amending said section <br />so as to increase the amount of death benefits payable to certain survivors of employees who die on <br />or after their early sewice retirement date but prior to their normal service retirement date and have <br />accumulated contrib ~tions in an amount which is less than one hundred (100) percent of their final <br />average compensatk.n; so that said section, as so amended, shall read as follows: <br /> <br />2.64.120 Benefits other than on retirement. <br /> <br />If the membership of an employee is terminated by reason of death prior to the employee's <br />normal service retirement date, the amount of the employee's accumulated contributions <br />shall be paya.)le in a lump sum to the employee's designated beneficiary. <br /> <br />If the amount payable under subsection A of this section is less than fifty (50) percent of the <br />employee's tinal average compensation, then an additional amount to bring the death <br />payment to fi"ty (50) percent of the employee's final average compensation shall be payable <br />in a lump stun to the employee's widow or widower, or if no widow or widower to the <br />employee's rr inor child or minor children in equal shares. If no widow or widower or minor <br />children surv/ve the deceased member, no benefit shall be payable under this subsection. <br /> <br />If the amount payable under subsection A of this section is less than one hundred (100) <br />percent of th~ employee's final average compensation and the death was on or after the <br />employee's e ~rly service retirement date, then an additional amount to bring the death <br /> <br /> <br />
