Nothing in this section shall be construed to prohibit the sale or delivery of any <br />intoxicating liquor during any of the hours or on any of the days specified in this <br />section by a wholesaler licensed under the provisions of Section 311.180 RSMo to <br />a person licensed to sell the intoxicating liquor at retail. <br /> <br />When January first, March seventeenth, July fourth, or Decemberthirty-first falls on <br />Sunday, and on Sundays prior to Memorial Day and Labor Day and on the Sunday <br />on which the national championship game of National Football League is played, <br />commonly known as "Super Bowl Sunday," any person having a license to sell <br />intoxicating liquor by the drink may be open for business and sell intoxicating liquor <br />by the drink under the provisions of law to the contrary. <br /> <br />Any person licensed to sell intoxicating liquor under this article, who is licensed <br />under the provisions of Section 311.097 RSMo (restaurant bar) or 311.293 .RSMo <br />(package liquor) to sell intoxicating liquor between the hours of eleven a.m. and <br />midnight on Sunday, or who is licensed under the provisions of Section 311.090 <br />RSMo (certain tax-exempt organizations) to sell intoxicating liquor between the <br />hours of eleven a.m. and midnight on Sunday and is a music school licensed pursuant <br />to Section 5.08.090(C)(4)(a), may apply to the finance director for a license to sell <br />intoxicating liquor on Sunday. A license, under this subsection shall pay to the <br />finance director an additional fee of three hundred dollars ($300.00) a year for the <br />privilege of selling intoxicating liquor on Sunday, payable at the same time and in <br />the same manner as its other license fees. <br /> <br />Any person licensed to sell intoxicating liquor on Sunday pursuant to subsection E <br />of this section may be open for business and sell intoxicating liquor between the <br />hours of one p.m. and midnight on Sunday, notwithstanding any provisions of law <br />to the contrary. <br /> <br />Any person licensed to sell intoxicating liquor under this article, who is licensed <br />under the provisions of section 311.097 RSMo (restaurant bar) and subsection E of <br />this section, may be open for business and sell intoxicating liquor by the drink at <br />retail for consumption on the premises between the hours of eleven a.m. and <br />midnight on Sunday, notwithstanding any provisions of the law to the contrary. <br /> <br /> Section 2. This ordinance shall not be construed so as to relieve any person, firm or <br />corporation from any penalty heretofore incurred by the violation of Section 5.08.240, nor bar the <br />prosecution for any such violation. <br /> <br /> Section 3. Any person, firm, or corporation violating any of the provisions of this <br />ordinance shall, upon conviction thereof, be subject to the penalty provided in Chapter 1.12, Section <br />1.12.010 of the University City Municipal Code. <br /> <br /> Section 4. <br />provided by law. <br /> <br />This ordinance shall take effect and be enforce from and after its passage as <br /> <br /> <br />
