BILL NO. ~t~' <br /> <br />ORDINANCE NO. <br /> <br />AN ORDINANCE GRANTING, SELLING AND CONVEYING TO THE <br />METROPOLITAN ST. LOUIS SEWER DISTRICT AN EASEMENT IN LOT 46 <br />OF BLOCK 32 OF DARSTDALE NO. 2 SUBDMSION IN UNIVERSITY CITY, <br />MISSOURI; CONTAINING AN EMERGENCY CLAUSE. <br /> <br /> WHEREAS, the Metropolitan St. Louis Sewer District desires to construct and ma'mtain the <br />Archer-Braddock-Coolidge-Grant Storm Channel within property owned by the City of University <br />City, Missouri; and <br /> <br /> WHEREAS, said property is located in Lot 46 of Block 32 of Dasrtdale No. 2 Subdivision; <br />and <br /> <br /> WHEREAS, the Metropolitan St. Louis Sewer District has requested an easement in the <br />property for said purposes; and <br /> <br /> WHEREAS, the easement will further the preservation of the health, safety, morals and <br />general welfare of the people of the City of University City; and <br /> <br /> WHEREAS, the City of University City is willing to grant, sell and convey the requested <br />easement to the Metropolitan St. Louis Sewer District. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />UNIVERSITY CITY, MISSOURI, AS FOLLOWS: <br /> <br /> Section 1. <br />follows: <br /> <br />The City of Uuiversity City, Missouri is the owner of property described as <br /> <br />Lot 46 of Block 32 of Darstdale No. 2, Plat Book 23, Page 16, in University City, St. Louis <br />County, Missouri. <br /> <br /> Section2. In consideration for the sum of one dollar ($1.00) and other valuable <br />consideration, the receipt and sufficiency of which is hereby acknowledged, the City of University <br />City hereby grants, sells and conveys an easement in said property to the Metropolitan St. Louis <br />Sewer District, subject to the terms and conditions set forth in the Easement marked "Exhibit 1" and <br />made a part hereof. <br /> <br /> Section 3. The City Manager of the City of University City, Missouri is hereby <br />authorized and directed to enter into and execute said Easement on behalf of the City of University <br />City, Missouri. <br /> <br /> Section 4. It is hereby declared that an emergency exists in that storm channel work <br />under way cannot continue unless the easement is granted; and delay could cause financial hardship <br /> <br /> <br />
