B L O. q(J <br /> <br />ORDINANCE NO. ~ <br /> <br />AN ORDINANCE VACATING AND SURRENDERING A PUBLIC WALKWAY <br />RIGHT-OF-WAY FROM NORTH & SOUTH BOULEVARD TO CENTRAL <br />AVENUE IN BLOCK 4 OF DELMAR HEIGHTS SUBDIVISION AND <br />DIRECTING THAT THIS ORDINANCE BE RECORDED IN THE OFFICE OF <br />THE RECORDER OF DEEDS OF ST. LOUIS COUNTY, MISSOURI. <br /> <br /> WHEREAS, there is a right-of-way for a public walkway in Delmar Heights Subdivision <br />in University City, in St. Louis County, Missouri; and <br /> <br /> WHEREAS, due notice of a public hearing to be held by the City Council in the City Council <br />Chambers at City Hall on January 10, 2000 at 7:30 p.m., to hear any comments conceming the <br />proposed vacation of said right-of-way, was duly published in the St. Louis Countian, a newspaper <br />of general circulation within said City, on December 30, 1999; and <br /> <br /> WHEREAS, said public hearing was held at the time and place specified in said notice, and <br />all comments concerning the proposed vacation of said right-of-way were duly heard and considered <br />by the City Council. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />UNIVERSITY CITY, MISSOURI, AS FOLLOWS: <br /> <br /> Section 1. The right-of-way of a public walhvay in University City, in St. Louis County, <br />Missouri, and all of University City's right, title and interest therein is hereby vacated, surrendered <br />and quitclaimed, reserving, however, all public utility easements, if any; said property is more <br />specifically described as follows: <br /> <br />The parcel of land lies within Block 4 of Delmar Heights Subdivision, a subdivision within <br />the City of University City, Missouri, and in St. Louis County, Missouri. The subdivision <br />is recorded in Book 14, pages 34 and 35 of the records of the St. Louis County Recorder of <br />Deeds, and was filed November 8, 1920. The parcel is 6' wide and approximately 302.65' <br />long, and lies along lots 5,6, 27 and 28 of Block 4 of Delmar Heights Subdivision. The <br />parcel contains an area of approximately 1,816 square feet, or 0.042 acres, more or less. <br /> <br /> Section2. TheCityClerkisherebydirectedtohavethisordinancerecordedintheoffice <br />of the Recorder of Deeds of St. Louis County, Missouri. <br /> <br />Section 3. This ordinance shall take effect and be in force from and after the passage <br />provided by law. <br /> <br /> <br />
