BILL NO. <br /> <br />9P1261 i')1027 <br /> <br />ORDINANCE NO. t Aq 3, <br /> <br />AN ORDINANCE VACATING AND SURRENDERING A PUBLIC RIGHT-OF- <br />WAY BETWEEN BIRCHMONT DRIVE AND WAYNE AVENUE, EAST OF 79TM <br />STREET, IN BLOCK 9 OF BELMONT HILLS NUMBERS 2 AND 3 <br />SUBDIVISIONS, AND DIRECTING THAT THIS ORDINANCE BE RECORDED <br />IN THE OFFICE OF THE RECORDER OF DEEDS OF ST. LOUIS COUNTY, <br />MISSOURI. <br /> <br /> WHEREAS, there is a fight-of-way for a public walkway in Belmont Hills Numbers 2 and <br />3 subdivisions, in University City, in St. Louis County, Missouri; and <br /> <br /> WHEREAS, due notice of a public hearing to be held by the City Council in the City Council <br />Chambers at City Hall on April 17, 2000 at 7:30 p.m., to hear any comments concerning the <br />proposed vacation of said fight-of-way, was duly published in the St. Louis Countian, a newspaper <br />of general circulation within said City, on March 23, 2000; and <br /> <br /> WHEREAS, said public heating was held at the time and place specified in said notice, and <br />all comments concerning the proposed vacation of said right-of-way were duly heard and considered <br />by the City Council. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />UNIVERSITY CITY, MISSOURI, AS FOLLOWS: <br /> <br /> Section 1. The tight-of-way of a public walkway in University City, in St. Louis County, <br />Missouri, and all of University City's tight, title and interest therein is hereby vacated, surrendered <br />and quitclaimed, reserving, however, all public utility easements, if any; said property is more <br />specifically described as follows: <br /> <br />Parcel A is a 10 foot wide walkway located within Block 9 of Belmont Hills No. 3 <br />Subdivision located within Section 33, Township 46 N., Range 6E., and within the City of <br />University City, Missouri and St. Louis County, Missouri, and as recorded in Plat Book 48, <br />Patge 28 of the records of the St. Louis County Recorder of Deeds. Parcel A is a 10 foot <br />wide walkway beginning at the south fight-of-way line Birchmont Drive, 50 feet wide, a <br />street located within Belmont Hills No. 3 Subdivision, and extending 120 feet southward to <br />the south boundary line of Belmont Hills No. 3 Subdivision. Parcel A is bounded on the east <br />by the west boundary line of Lot 45 of Block 9 of Belmont Hills No. 3 Subdivision and <br />bounded on the west by the east boundary line of Lot 44 of Block 9 of Belmont Hills No. 3 <br />Subdivision. All existing utility easements located within Parcel A are to remain in effect. <br />The approximate land area contained within Parcel A is 1200 square feet or 0.028 acres, <br />more or less. <br /> <br />Parcel B is a 10 foot wide walkway located within Block 9 of Belmont Hills No. 2 <br />Subdivision located within Section 33, Township 46 N., Range 6 E., and within the City of <br /> <br /> <br />
