the City shall issue a Franchise by ordinance adopted no less than thirty (30) <br />days after the filing of the original application. <br /> <br />4. If the City Council denies a Franchise, it will issue a written decision <br />explaining why the Franchise was denied. <br /> <br />5. Prior to deciding whether or not to issue a Franchise. the City Council <br />shall hold a public hearing; however, the City may reject without hearing any <br />application that is incomplete or fails to respond fully to an RFP. <br /> <br />6. This Ordinance is not intended and shall not be interpreted to grant <br />standing to challenge the issuance of a Franchise to another Person, or to <br />limit such standing. <br /> <br />C. Application for Grant of a Cable Act Franchise Renewal. <br /> <br /> Applications for Franchise renewal under the Cable Act shall be received and <br />reviewed in a manner consistent with Section 626 of the Cable Act, 47 U.S.C. § 546. If <br />neither a Franchisee nor the City activates in a timely manner, or can activate, the renewal <br />process set forth in 47 U.S.C. § 546(a)-(g) (including, for example, if the provisions are <br />repealed), and except as to applications submitted pursuant to 47 U.S.C. § 546(h), the <br />provisions of Section 4(b) shall apply and a renewal request shall be evaluated using the <br />same criteria as any other request for a Franchise. The following requirements shall apply <br />to renewal requests properly submitted pursuant to the Cable Act: <br /> <br />1. a. <br /> <br />If the provisions of 47 U.S.C. § 546 (a)-(g) are properly <br />invoked, the City Council shall, in accordance with the time <br />limits of the Cable Act, commence and complete a proceeding <br />to review the applicant's performance under the Franchise <br />during the then current Franchise term and to identify future <br />cable-related community needs and interests. Upon <br />completion of the proceeding, the City Council may issue a <br />RFP. The City Council, or its designee, shall establish <br />deadlines and procedures for responding to the RFP, may <br />seek additional information from the applicant, and shall <br />establish deadlines for the submission of such additional <br />information. Alternatively, an applicant can submit a proposal <br />for renewal on its own initiative. <br /> <br />Following receipt of renewal proposals (and such additional <br />information as may be provided in response to requests), the <br />City Council will provide prompt public notice of such <br />proposals and thereafter either determine that the Franchise <br /> <br /> <br />
