I. Intergovernmental Cooperation. <br /> <br /> By resolution of the City Council, any part or all of the process established by this <br />Section 4 may be conducted in concert with other political subdivisions served or to be <br />served by the applicant. <br /> <br />V. Construction Provisions <br /> <br />A. System Construction Schedule. <br /> <br /> Every Franchise Agreement shall specify the construction schedule that will apply <br />to any required construction, upgrade, or rebuild of the Cable System. Failure on the part <br />of a Franchisee to commence and diligently pursue such requirements and complete the <br />matters set forth in its Franchise Agreement or to comply with the System design and <br />construction plan submitted to the City, including by providing the equipment specified (or <br />its equivalent) and by following generally accepted installation practices (except insofar <br />as those plans or practices, if carried out, would result in construction of a System which <br />could not meet requirements of federal, state or local law; and except for such minor <br />modifications as are typical in the industry), shall be grounds for revocation of its <br />Franchise under and pursuant to the terms of Section 12(e);provided, however, that the <br />City Council in its discretion may extend the time for the completion of construction and <br />installation for additional periods by resolution in the event a Franchisee, acting in good <br />faith, experiences delays by reason of circumstances beyond its control and requests such <br />an extension in writing. A Franchisee's failure to comply with provisions of the construction <br />plan approved by the City Council shall also be grounds for imposition of penalties <br />pursuant to Section 12(d). <br /> <br />B. Construction Procedures. <br /> <br />1. A Franchisee shall construct, operate and maintain the Cable System <br />subject to the supervision of all of the authorities of the City who have <br />jurisdiction in such matters, and in compliance with al laws, ordinances, <br />departmental rules and regulations affecting the System. <br /> <br />2. The System, and all parts thereof, shall be subject to periodic <br />inspection by the City. <br /> <br />3. No construction, reconstruction or relocation of the System or any part <br />thereof within the Public Right-of-Ways shall be commenced until written <br />permits have been obtained from the proper City officials.
