BILL NO. <br /> <br />AN ORDINANCE APPROVING A FiNAL SUBDIVISION PLAT OF A TRACT <br />OF LAND TO BE KNOWN AS LOTS 10-14 OF BLOCK 2 OF NEW DELMAR <br />HEIGHTS SUBDIVISION AND LOCATED AT 519-535 NORTH AND SOUTH <br />BOULEVARD, THEREBY APPROVING THE CREATION OF A <br />CONDOMINIUM FORM OF OWNERSHIP OF THE PROPERTY; CONTAINING <br />AN EMERGENCY CLAUSE. <br /> <br /> WHEREAS, Manlin Realty, Inc; on behalf of Beringer Land Company, Inc., submitted for <br />approval a final subdivision of a tract offand to be known as Lots 10-14 of Block 2 of New Delmar <br />Heights Subdivision in University City, Missouri; and <br /> <br /> WHEREAS, at its meeting on May 24, 2000, the University City Plan Commission reviewed <br />the final subdivision plat and recommended to the City Council of University City approval of the <br />final plat; and <br /> <br /> WHEREAS, the final subdivision plat application, including all required documents and <br />information, is before the City Council for its consideration. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />UNIVERSITY CITY, MISSOURI, AS FOLLOWS: <br /> <br /> Section 1. Attached, marked Exhibit "A" and made a part hereof is a final subdivision <br />plat of a tract of land to be known as Lots 10-14 of Block 2 of New Delmar Heights Subdivision and <br />located at 519 (Lot 14), 523 (Lot 13), 527 (Lot 12), 531 (Lot 11), and 535 (Lot 10) North and South <br />Boulevard in University City, St. Lois County, Missouri. The final subdivision plat creates a <br />condominium form of ownership of the property. <br /> <br /> Section 2. It is hereby found and determined that the final subdivision plat is in full <br />compliance with the University City Municipal Code, including Section 16.12.240 thereof. <br />Accordingly, the final subdivision plat marked Exhibit "A" is hereby approved. <br /> <br /> Section 3. The City Clerk is hereby directed to endorse upon the final subdivision plat <br />the approval of the City Council under the hand of the City Clerk and the seal of University City. <br /> <br /> Section 4. It is hereby declared that an emergency exists in that the purchasers of four <br />condominium units located on the property must close and take possession immediately because they <br />have no feasible housing alternative and at least two financing commitments will expire. The final <br />subdivision plat must be approved and recorded before title and possession can be transferred to the <br />purchasers. <br /> <br />Section 5. This ordinance shall take effect and be in force from and after its passage as <br /> <br /> <br />
