ORDINANCE NO. ha'5_5 AN ORDNANCE VACATING AND SURRENDERING THE RIGHT-OF-WAY OF ESSEN AVENUE IN NORTHMOOR SUBDIVISION, BUT RESERVING ANY PUBLIC UTILITY EASEMENTS, AND DIRECTING THAT THIS ORDINANCE BE RECORDED IN THE OFFICE OF THE RECORDER OF DEEDS OF ST. LOLlIS COUNTY, MISSOURI. WHEREAS, Essen Avenue is a public street in Northmoor Subdivision in University City, in St. Louis County, Missouri; and WHEREAS, due notice of a public hearing, to be held by the City Council in the City Council Chambers at City Hall on June 19, 2000 at 7:30 p.m., to hear any comments concerning the proposed vacation of said street right-of-way, was duly published in the St. Louis Countian, a newspaper of general circulation within said City, on June 13, 2000; and WHEREAS, said public hearing was held at the time and place specified in said notice, and all comments concerning the vacation of said street right-of-way were duly heard and considered by the City Council. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, MISSOURI, AS FOLLOWS: Section 1. The fight-of-way of a public street known as Essen Avenue, in University City, in St. Louis County, Missouri, and all of the City of University City's right, title and interest therein is hereby vacated, surrendered and quitclaimed, reserving, however, all public utility easements, if any; said property is more specifically described as follows: The parcel being vacated is the street Essen Ave. (40 feet wide x 150 feet long), beginning at the south right-of-way line of Forsyth Blvd. (80 feet wide) and extending 150 feet southwardly along Essen Ave. centerline, and is more particularly described as follows: Essen Ave. (40 feet wide by 150 feet long) is located within Northmoor Subdivision within U.S. Survey 378 of Township 45 N., Range 6 E. and within the City of University City, Missouri and St. Louis County, Missouri, and as recorded in Plat Book 13, Pages 38 and 39 of the records of the St. Louis County Recorder of Deeds. The parcel of land being vacated is bounded on the north by the south right-of-way line ofForsyth Blvd., and bounded on the east by the west boundary line of Lot 33 of Block 1 of Northmoor Subdivision, and bounded on the south by the south boundary line of Northmoor Subdivision, and bounded on the west by the east boundary line of Lot 1 of Block 2 of Northmoor Subdivision. All existing utility easements located within the above described parcel shall remain in effect. The approximate land area contained within the above described parcel is 6000 square feet or 0. 1 377 acres more or less.
