BILL NO. ghtq~ ORDINANCE NO. <br /> <br />AN ORDINANCE AMENDING CHAPTER 9.12 OF THE UNIVERSITY CITY <br />MUNICIPAL CODE, RELATING TO THEFT AND RELATED OFFENSES, BY <br />ENACTING THEREIN A NEW SECTION TO BE KNOWN AS "SECTION <br />9.12.080 IDENTITY THEFT-RESTITUTION;" CONTAINING A SAVING <br />CLAUSE AND PROVIDING A PENALTY. <br /> <br /> BE IT ORDAINlED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, <br />MISSOURI, AS FOLLOWS: <br /> <br /> Section 1. Chapter 9.12 of the University City Municipal Code, relating to theft and <br />related offenses, is hereby amended by enacting therein a new section to be known as "Section <br />9.12.080 Identity theft-Restitution," which shall read as follows: <br /> <br />A person commits the violation of identity theft if he or she knowingly and with <br />intent to deceive or defi'aud obtains, possesses, transfers, uses, or attempts to obtain, <br />transfer or use, one or more means of identification not lawfully issued for his or her <br />use. <br /> <br />In addition to the general penalty provided in this code, the court may order that the <br />defendant make restitution to any victim of the violation. Restitution may include <br />payment for any costs, including attorney fees, incurred by the victim: <br /> <br />1. In clearing the credit history or credit rating of the victim; and <br /> <br />In connection with any civil or administrative proceeding to satisfy any debt, <br />lien or other obligation of the victim arising from the actions of the <br />defendant. <br /> <br /> Section 2. This ordinance shall not be construed so as to relieve any person, firm or <br />corporation from any penalty heretofore incurred by violation of Chapter 9.12, nor bar the <br />prosecution for any such violation. <br /> <br /> Section 3. Any person, firm or corporation violating any of the provisions of this <br />ordinance shall, upon conviction thereof, be subject to the penalty provided in Chapter 1.12, Section <br />1.12.010 of the University City Municipal Code. <br /> <br /> Section 4. <br />provided by law. <br /> <br />PASSED this <br /> <br />This ordinance shall take effect and be in force from and after its passage as <br /> <br /> c'~ day of /~J~ ,2000. <br /> <br /> <br />
