E P13211/1578 ORDINANCE NO. ~V AN ORDINANCE VACATING AND SURRENDERING A PORTION OF THE RIGHT-OF-WAY OF HAIkRISON AVENUE BETWEEN HAWTHORNE PLACE AND WAYNE AVENUE IN BELLEMONT PLACE SUBDIVISION AND HAWTHORNE TERRA,CE SUBDIVISION, BUT RESERVING ANY PUBLIC UTILITY EASEMENTS, AND DIRECTING THAT THIS ORDINANCE BE RECORDED IN THE OFFICE OF THE RECORDER OF DEEDS OF ST. LOUIS COUNTY, MISSOURI. WHEREAS, HarrisOn Avenue is a public street in Bellemont Place Subdivision and Hawthorne Terrace Subdivision in University City, in St. Louis County, Missouri; and WHEREAS, due notice of a public hearing, to be held by the City Council in the City Council Chambers at City Hall on December 18, 2000 at 7:30 p.m., to hear any comments concerning the proposed vacation of two portions of said fight-of-way, was duly published in the St. Louis Countian, a newspaper of general circulation within said City, on December 1, 2000; and WHEREAS, said public hearing was held at the time and place specified in said notice, and all comments concerning the vacation of two portions of street fight-of-way were duly heard and considered by the City Council. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, MISSOIXLI, AS FOLLOWS: Section 1. One portion of the right-of-way of a public street known as Harrison Avenue, adjacent to 7601 Hawthorne Place in University City, in St. Louis County, Missouri, and all of the City of University City's right, title and interest therein is hereby vacated, surrendered and quitclaimed, reserving, however, all public utility easements, if any; said property is more specifically described as follows: PARCEL C Parcel C is irregularly shaped and is approximately 40 feet x 109 feet, and is located in fight- of-way of Harrison Ave. (90 feet wide), and within the Hawthorne Terrace Subdivision, a Subdivision of Lot 1 and part of Lot 2 of Bellemont Place, in the City of University City, in St. Louis County, Missouri and recorded in Book 37, Page 4 of the records of the St. Louis County Recorder of Deeds, and is more particularly described as follows: Beginning at a point 31.9 feet east of the southwest comer of Lot 13, Block 1 of the Hawthorne Terrace Subdivision and on the north right-of-way line of Hawthorne Place (505 feet wide), then proceed 60 feet eastwardly along the prolongation of the north right-of-way of Hawthorne Place (50 t~,et wide) to a point located in Harrison Avenue fight-of-way (90 feet wide). Then proceed 109 feet northwardly along a line that is parallel to and 40 feet east of the west right-of-way line of Harrison Avenue (90 feet wide) to a point. Then proceed 40
