BILL NO. ~t.~ ~. ORDINANCE NO. ~ AN ORDINANCE ESTABLISHING A SIX (6) MONTH MORATORIUM DURING WHICH SEXUALLY ORIENTED BUSINESSES SHALL NOT BE APPROVED OR ANY PERMIT AUTHORIZING ANY SUCH USE GRANTED; CONTAINING A SAVING CLAUSE, PROVIDING A PENALTY, AND CONTAINING AN EMERGENCY CLAUSE. WHEREAS, the City of University City has undertaken a study of the issues related to "adult" or sexually oriented businesses and said study has not yet been completed; and WHEREAS, such uses may have a significant effect within the City and it is essential to complete such study in order to determine their impact in terms of their secondary effects and to develop content-neutral regulations directed to any adverse secondary effects of such uses; and WHEREAS, a reasonable period of time will allow for the completion of such study; and WHEREAS, the City Plan Commission, in a meeting at City Hall on May 23, 2001, considered such matters and has recommended to the City Council that a moratorium of six (6) months be established, during which sexually oriented businesses, including adult book stores, adult novelty stores, adult video stores, adult places of entertainment and other sexually oriented businesses shall not be approved or any permit authorizing such use granted, so as to permit such study to be completed; and WHEREAS, due notice of a public hearing to be held by the City Council in the City Council Chambers at City Hall at 7:30 p.m., June 25, 2001, was duly published in the St. Louis Countian, a newspaper of general circulation within said City on June 9, 2001; and WHEREAS, said public hearing was held at the time and place specified in said notice, and all suggestions or objections concerning said moratorium were duly heard and considered by the City Council. NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, MISSOURI, AS FOLLOWS: Section 1. There is hereby established a moratorium period of six (6) months from the effective date of this ordinance during which sexually oriented businesses, including adult book stores, adult novelty stores, adult video stores, adult places of entertainment and other sexually oriented businesses shall not be approved or any permit authorizing any such use granted. Section 2. This ordinance shall not be construed so as to relieve any person, firm or corporation from any penalty incurred by the violation of Chapter 34, nor bar the prosecution of any such violation.
