(0.3 0 <br /> <br />AN ORDINANCE AMENDING CHAPTER 10.16 OF THE UNIVERSITY CITY <br />MUNICIPAL CODE, RELATING TO RULES OF THE ROAD, BY REPEALING <br />SECTION 10.16.320 THEREOF, RELATING TO DRIVING WITH EXCESSIVE <br />BLOOD ALCOHOL CONTENT, AND ENACTING IN LIEU THEREOF A NEW <br />SECTION TO BE KNOWN AS "SECTION 10.16.320 DRIVING WITH <br />EXCESSIVE BLOOD ALCOHOL CONTENT," THEREBY AMENDING SAID <br />SECTION SO AS TO LOWER THE PROHIBITED CONTENT FROM TEN- <br />HUNDREDTHS OF ONE PERCENT TO EIGHT-HUNDREDTHS OF ONE <br />PERCENT; CONTAINING A SAVING CLAUSE AND PROVIDING A <br />PENALTY. <br /> <br /> BE IT ORDAINED BY THE COUN,CIL OF THE CITY OF UNIVERSITY CITY, <br />MISSOURI, AS FOLLOWS: <br /> <br /> Section 1. Chapter 10.16 of the University City Municipal Code, relating to rules of the <br />road, is hereby amended by repealing Section 10.16.320 thereof, relating to driving with excessive <br />blood alcohol content, and enacting in lieu thereofa new section to be known as "Section 10.16.320 <br />Driving with excessive blood alcohol content," thereby amending said section so as to lower the <br />prohibited content from ten-hundredths of one percent to eight-hundredths of one percent; so that <br />said section, as so amended, shall read as follows: <br /> <br />10.16.320 Driving with excessive blood alcohol content. <br /> <br />Ao <br /> <br />Bo <br /> <br />Co <br /> <br />A person commits the violation of driving with excessive blood alcohol content if <br />such person operates a motor vehicle with eight-hundredths of one percent or more <br />by weight of alcohol in such a person's blood. <br />As used in this section, percent by weight of alcohol in the blood shall be based upon <br />grams of alcohol per one hundred (100) milliliters of blood or two hundred ten (210) <br />liters of breath and may be shown by chemical analysis of the person's blood, breath, <br />saliva or urine. For purposes of determining the alcoholic content of a person's <br />blood under this section, the test shall be conducted in accordance with the <br />provisions of Sections 577.020 to 577.041 RSMo. <br />As used in this section, "driving" or" operate" means physically driving or operating <br />a motor vehicle. <br /> <br /> Section 2. This ordinance shall not be construed so as to relieve any person, firm or <br />corporation from any penalty heretofore incurred by violation of Section 10.16.320, nor bar the <br />prosecution for any such violation. <br /> <br /> <br />
