BILL NO. ,~¢ ORDINANCE NO. /~,~/ <br /> <br />AN ORDINANCE AMENDING CHAPTER 9.08 OF THE UNIVERSITY CITY <br />MUNICIPAL CODE, RELATING TO OFFENSES AGAINST PUBLIC PEACE <br />AND DECENCY, BY ENACTING THEREIN A NEW SECTION TO BE KNOWN <br />AS "SECTION 9.08.015 ELDER ABUSE IN THE THIRD DEGREE;" <br />CONTAINING A SAVING CLAUSE AND PROVIDING A PENALTY. <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, AS <br />FOLLOWS: <br /> <br /> Section 1. Chapter 9.08 of the University City Municipal Code, relating to offenses <br />against public peace and decency, is hereby amended by enacting therein a new section to be known <br />as "Section 9.08.015 Elder abuse in the third degree," which shall read as follows: <br /> <br />Section 9.08.015 Elder abuse in the third de~ee. <br /> <br />A person commits the violation of elder abuse in the third degree if he or she: <br /> <br />Ao <br /> <br />Knowingly causes or attempts to cause physical contact with any person sixty years <br />of age or older or an eligible adult as defined in Section 660.250 RSMo, knowing the <br />other person will regard the contact as harmful or provocative; or <br />Purposely engages in conduct involving more than one incident that causes grave <br />emotional distress to a person sixty years of age or older or an eligible adult, as <br />defined in Section 660.250 RSMo. The course of conduct shall be such as would <br />cause a reasonable person age sixty years of age or older or an eligible adult, as <br />defined in Section 660.250 RSMo, to suffer substantial emotional distress; or <br />Purposely or knowingly places a person sixty years of age or older or an eligible <br />adult, as defined in Section 660.250 RSMo, in apprehension of immediate physical <br />injury; or <br />Intentionally fails to provide care, goods or services to a person sixty years of age or <br />older or an eligible adult, as defined in Section 660.250 RSMo. The cause of the <br />conduct shall be such as would cause a reasonable person age sixty or older or an <br />eligible adult, as defined in Section 660.250 RSMo, to suffer physical or emotional <br />distress; or <br />Knowingly acts or knowing fails to act in a manner which results in a grave risk to <br />the life, body or health ora person sixty years of age or older or an eligible adult, as <br />defined in Section 660.250 RSMo. <br /> <br /> Section 2. This ordinance shall not be construed so as to relieve any person, firm or <br />corporation from any penalty heretofore incurred by violation of Chapter 9.08, nor bar the <br />prosecution for any such violation. <br /> <br /> <br />
