AN ORDINANCE AMENDING CHAPTER 9.08 OF THE UNIVERSITY CITY <br />MUNICIPAL CODE, RELATING TO OFFENSES AGAINST PUBLIC PEACE <br />AND DECENCY, BY ENACTING THEREIN A NEW SECTION TO BE KNOWN <br />AS "SECTION 9.08.025 DOMESTIC ASSAULT IN THE THIRD DEGREE;" <br />CONTAINING A SAVING CLAUSE AND PROVIDING A PENALTY. <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, AS <br />FOLLOWS: <br /> <br /> Section 1. Chapter 9.08 of the University City Municipal Code, relating to offenses <br />against public peace and decency, is hereby amended by enacting therein a new section to be known <br />as "Section 9.08.025 Domestic assault in the third degree," which shall read as follows: <br /> <br />Section 9.08.025 Domestic assault in the third degree. <br /> <br />A person commits the violation of domestic assault in the third degree if the act involves a <br />family or household member or an adult who is or has been in a continuing social <br />relationship of a romantic or intimate nature with the actor, as defined in Section 455.010 <br />RSMo, and: <br /> <br />B. <br /> <br />C. <br /> <br />D. <br /> <br />E. <br /> <br />F. <br /> <br />The person attempts to cause or recklessly causes physical injury to such family or <br />household member; or <br />With criminal negligence the person causes physical injury to such family or <br />household member by means of a deadly weapon or dangerous instrument; or <br />The person purposely places such family or household member in apprehension of <br />immediate physical injury by any means; or <br />The person recklessly engages in conduct which creates a grave risk of death or <br />serious physical injury to such family or household member; or <br />The person knowingly causes physical contact with such family or household <br />member knowing the other person will regard the contact as offensive; or <br />The person knowingly attempts to cause or causes the isolation of such family or <br />household member by unreasonably and substantially restricting or limiting such <br />family or household member's access to other persons, telecommunication devices <br />or transportation for the purpose of isolation. <br /> <br /> Section 2. This ordinance shall not be construed so as to relieve any person, firm or <br />corporation from any penalty heretofore incurred by violation of Chapter 9.08, nor bar the <br />prosecution for any such violation. <br /> <br /> Section 3. Any person, firm or corporation violating any of the provisions of this <br />ordinance shall, upon conviction thereof, be subject to the penalty provided in Chapter 1.12, Section <br />1.12.010 of the University City Municipal Code. <br /> <br /> <br />
