ORDINANCE NO. ~ <br /> <br />AN ORDINANCE AMENDING CHAPTER 8.28 OF THE UNIVERSITY CITY <br />MUNICIPAL CODE, RELATING TO 'THE PROPERTY MAINTENANCE CODE, <br />BY REPEALING SUBSECTION PM-112.4.2 OF SECTION 8.28.020 THEREOF, <br />RELATING TO CONDITIONAL PERMITS, AND BY ENACTING IN LIEU <br />THEREOF A NEW SUBSECTION TO BE KNOWN AS "PM-112.4.2 <br />CONDITIONAL PERMIT,"THEREBY AMENDING SUBSECTION PM-112.4.2 <br />SO AS TO SHORTEN FROM NINETY (90) DAYS TO SIXTY (60) DAYS THE <br />PERIOD IN WHICH PREMISES SHOULD BE BROUGHT INTO COMPLIANCE <br />WITH THE CODE UNDER A CONDITIONAL PERMIT; CONTAINING A <br />SAVING CLAUSE AND PROVIDING A PENALTY. <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, <br />MISSOURI, AS FOLLOWS: <br /> <br /> Section 1. Chapter 8.28 ofthe University City Municipal Code, relating to the property <br />maintenance code, is hereby amended by repealing Subsection PM-112.4.2 of Section 8.28.020 <br />thereof, relating to conditional permits, and by enacting in lieu thereofa new subsection to be known <br />as Subsection "PM-112.4.2 Conditional Permit," so that said subsection, as so amended, shall read <br />as follows: <br /> <br /> PM-112.4.2 Conditional permit: Occupation shall be pcrmitted on a conditional basis when <br />in the judgment of the code official practical difficulties interfere with completing all repairs <br />required to bring the premises into full compliance with this code prior to pen'nitting the occupation <br />of the premises, there are no conditions on the premises which threaten the health or safety of an <br />occupant, and the code official ils satisfied that the premises will be brought into compliance with <br />the requirements of this code within a sixty (60) day period. No conditional permit shall be issued <br />under the provisions of this code for premises which have been newly constructed, newly altered, <br />or on which a change in use is proposed unless a Certificate o fOccupancy has first been issued under <br />the provisions of the building code. <br /> <br /> Section 2. This ordinance shall not be construed so as to relieve any person, firm or <br />corporation from any penalty heretofore incurred by the violation of Chapter 8.28, Section 8.28.020, <br />nor bar the prosecution for any such violation. <br /> <br /> Section 3. Any person, firm, or corporation violating any of the provisions of this <br />ordinance shall, upon conviction thereof, be subject to the penalty provided in Chapter 1.12, Section <br />1.12.010 of the University City Municipal Code. <br /> <br /> Section 4. <br />provided by law. <br /> <br />This ordinance shall take effect and be in force from and after its passage as <br /> <br /> <br />
