INTRODUCED BY COUNCILMEMBER <br />BILL NO. ~'q5 ORDINANCE NO. ~ <br /> AN ORDINANCE OF THE CITY OF UNIVERSITY CITY, MISSOURI, <br /> EXTENDING THE TERM OF FRANCHISE WITH CHARTER <br /> COMMUNICATIONS ENTERTAINMENT I, L.L.C. TO APRIL 23, 2002. <br /> <br /> WHEREAS, Charter Communications Entertainment I, L.L.C. ("Charter"), is the current <br />holder and operator of a non-exclusive cable television franchise granted by the City of <br />University City, Missouri pursuant to a transfer from Continental Cablevision of St. Louis, L.P. <br />(Continental); and <br /> <br /> WHEREAS, Charter and the City properly commenced proceedings during the six month <br />period beginning with the 36th month before franchise expiration pursuant to 47 USC 546 (a) <br />and properly continue to conduct such proceedings with the purpose of considering possible <br />renewal of the franchise; and <br /> <br />WHEREAS, Charter has recently requested transfer of its existing franchise; and <br /> <br /> WHEREAS, passage of this Ordinance will not in any way alter the City's powers to <br />continue conducting the proceedings under 47 USC 546 (a) (which proceedings shall not be <br />concluded until the City provides written notice of such conclusion to the holder of the franchise) <br />and otherwise conduct formal and informal franchise renewal proceedings under 47 USC 546; <br />and <br /> <br /> WHEREAS, the City and Charter have been unable to properly complete negotiations <br />before expiration of the extended franchise and, therefore, an extension of the franchise <br />expiration date to 11:59 p.m. on April 23, 2002 is necessary and in the best interest of the City <br />and its residents; and <br /> <br /> WHEREAS, based upon the foregoing information, representations, and circumstances, <br />the City Council has concluded that it is in the best interest of the City and its residents and <br />businesses to grant consent to extend the term of the franchise subject to certain conditions. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />UNIVERSITY CITY, MISSOURI, AS FOLLOWS: <br /> <br /> Section 1. Extension of Franchise Term. The terms of the cable television franchise <br />granted by the City to Continental which was transferred to Charter is hereby extended so as to <br />expire at 11:59 p.m. on April 23, 2002. The continued operation of the cable system by Charter <br />shall be deemed consent to this extension. <br /> <br /> Section 2. Effective Date. This Ordinance shall take effect and be in full force from and <br />after its passage as provided by law. <br /> <br /> <br />
