INTRODUCED BY COUNCILMEMBER <br /> <br />AN ORDINANCE OF THE CITY OF UNIVERSITY CITY, MISSOURI, <br />EXTENDING THE TERM OF FRANCHISE WITH CHARTER <br />COMMUNICATIONS ENTERTAINMENT I, L.L.C. TO October 23, 2002. <br /> <br /> WHEREAS, Charter Communications Entertainment I, L.L.C. ("Charter"), is the <br />current holder and operator of a non-exclusive cable television franchise granted by the <br />City of University City, Missouri pursuant to a transfer fi.om Continental Cablevision of <br />St. Louis, L.P. (Continental); and <br /> <br /> WHEREAS, Charter and the City properly commenced proceedings during the six <br />month period beginning with the 36th month before franchise expiration pursuant to 47 <br />USC 546 (a) and properly continue to conduct such proceedings with the purpose of <br />considering possible renewal of the franchise; and <br /> <br />WHEREAS, Charter has recently requested transfer of its existing fi'anchise; and <br /> <br /> WHEREAS, passage of this Ordinance will not in any way alter the City's powers <br />to continue conducting the proceedings under 47 USC 546 (a) (which proceedings shall <br />not be concluded until the City provides written notice of such conclusion to the holder of <br />the franchise) and otherwise conduct formal and informal franchise renewal proceedings <br />under 47 USC 546; and <br /> <br /> WHEREAS, the City and Charter have been unable to properly complete <br />negotiations before expiration of the extended franchise and, therefore, an extension of <br />the franchise expiration date to 11:59 p.m. on October 23, 2002 is necessary and in the <br />best interest of the City and its residents; and <br /> <br /> WHEREAS, based upon the foregoing information, representations, and <br />circumstances, the City Council has concluded that it is in the best interest of the City and <br />its residents and businesses to grant consent to extend the term of the fi'anchise subject to <br />certain conditions. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />UNIVERSITY CITY, MISSOURI, AS FOLLOWS: <br /> <br /> Section 1. Extension of Franchise Term. The terms of the cable television franchise <br />granted by the City to Continental which was transferred to Charter is hereby extended so <br />as to expire at 11:59 p.m. on October 23, 2002. The continued operation of the cable <br />system by Charter shall be deemed consent to this extension. <br /> <br /> Section 2. Effective Date. This Ordinance shall take effect and be in full force from <br />and after its passage as provided by law. <br /> <br /> <br />
