(~13 <br /> <br />AN ORDINANCE VACATING AND SURRENDERING THE RIGHT- <br />OF-WAY BETWEEN 6850 AND 6900 BARTMER AVENUE IN THE <br />ROTH GROVE SUBDIVISION, BUT RESERVING ANY PUBLIC <br />UTILITY EASEMENTS, AND DIRECTING THAT THIS ORDINANCE <br />BE RECORDED IN THE OFFICE OF THE RECORDER OF DEEDS OF <br />ST. LOUIS COUNTY, MISSOURI. <br /> <br /> WHEREAS, Purcell alley is a public right-of-way between 6850 and 6900 <br />Bartmer Avenue in the Roth Grove Subdivision in University City, in St. Louis County, <br />Missouri; and <br /> <br /> WHEREAS, due notice of a public hearing, to be held by the City Council in the <br />City Council Chambers at City Hall on August 12, 2002, at 7:30 p.m., to hear any <br />comments concerning the proposed vacation of said right-of-way, was duly published in <br />the St. Louis Countian, a newspaper of general circulation within said City, on July 31, <br />2002; and <br /> <br /> WHEREAS, said public hearing was held at the time and place specified in said <br />notice, and all comments concerning the vacation of said fight-of-way were duly heard <br />and considered by the City Council. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF UNIVERSITY CITY, MISSOURI, AS FOLLOWS: <br /> <br /> Section 1. The public right-of-way between 6850 and 6900 Bartmer Avenue <br />in the Roth Grove Subdivision in University City, in St. Louis County, Missouri, and all <br />of the City of University City's right, title and interest therein is hereby vacated, <br />surrendered and quitclaimed, reserving, however, all public utility easements, if any; said <br />property is more specifically described as follows: <br /> <br />Beginning at the southeast comer of Lot 18, Block 7 of Roth Grove Subdivision, <br />thence going eastwardly 25 feet along a line being the prolongation of the south <br />boundary line of Lot 18, Block 7 of Roth Grove Subdivision to a point lying on a <br />line one (1) foot east and parallel to the west boundary line of Lot 7 of Sutter <br />Estates, thence going 140 feet northwardly along the said line to a point, thence <br />going 25 feet westward along the prolongation of the south fight-of-way line of <br />Bartmer Avenue to a point, this point being the north east comer of Lot 18, Block <br />7 of Roth Grove Subdivision, thence going 140 feet southwardly to a point, this <br />being the point of beginning. <br /> <br /> <br />
