WHEREAS, Section H, p. 8 of the Plan permits the Council to modify the Plan, in the manner in which it was first approved; and WHEREAS, the Authority has authorized the requested Amendment by resolution passed October 8, 2002, and the Plan Commission has consented thereto by resolution passed October 8, 2002; and WHEREAS, this City Council has duly considered the reports, recommendations and certifications of the LCRA and the Plan Commission; and WHEREAS, after all proper notice was given, the City Council held a public hearing concerning the Amendment, and all those who were interested in being heard were given a reasonable opportunity to express their views. WHEREAS, it is necessary that this City Council take appropriate official action respecting the approval of the Amendment. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY AS FOLLOWS: SECTION ONE. The Plan and Amendment, having been duly reviewed and considered, are hereby approved and incorporated herein by reference, and the Clerk of this City Council is hereby directed to file a copy of said Amendment with the Minutes of this meeting. SECTION TWO. The Plan and Amendment for the Area are feasible and conforms to the general plan for the City. SECTION THREE. The financial aid provided and to be provided for financial assistance pertaining to the Area is necessary to enable the redevelopment activities to be undertaken in accordance with the Plan and Amendment for the Area, and the proposed financing plan for the Area is feasible. SECTION FOUR. The Plan and Amendment for the Area will afford maximum opportunity, consistent with the sound needs of the City as a whole, for the redevelopment of the Area by private enterprise, and private developments to be sought pursuant to the requirements of the Statute. SECTION FIVE. The Plan and Amendment for the Area provide that the LCRA may not acquire any property in the Area by the exercise of eminent domain. 1983680 PAGE 2
