BILL NO. ~ ~)'~ AN ORDINANCE AMENDING CHAPTER 6.08 OF THE UNIVERSITY CITY MUNICIPAL CODE, RELATING TO DOGS, BY ENACTING THEREIN A NEW SECTION TO BE KNOWN AS "SECTION 6.08.215 DOG PLAY AREAS;" CONTAINING A SAVINGS CLAUSE AND PROVIDING A PENALTY. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, MISSOURI AS FOLLOWS: Section 1. Chapter 6.08 of the University City Municipal Code, relating to dogs, is hereby amended by enacting therein a new section to be known as "Section 6.08.215 Dog play areas," which shall read as follows: Section 6.08.215 Dog play areas. Ao Notwithstanding Section 6.08.210, the City Manager may designate an area of city property for off-leash dog use if the City Manager determines that there is a need for such an area and it will be maintained so as not to create a nuisance. The area shall be known as a "dog play area." Use of a dog play area shall be subject to rules and regulations established by the City Manager to promote the health, safety and welfare of dog play area users and the general public. Only dogs licensed by the City to use the dog play area shall be permitted therein. The annual license fee to use a dog play area shall be thirteen dollars ($13.00), which shall be in addition to the annual dog license fee required by Section 6.08.030. The dog tag issued to the applicant and worn by the dog as required by Sections 6.08.040 and 6.08.050 shall indicate that the dog is permitted to use the dog play area. The City Manager may enter into an agreement with a person to operate, manage or maintain a dog play area, and compensate such person in an amount not to exceed the total annual license fees paid to the City to use the dog play area. Section 2. This ordinance shall not be construed so as to relieve any person, firm or corporation from any penalty heretofore incurred by the violation of Chapter 6.08, nor bar the prosecution for any such violation. Section 3. Any person, firm or corporation violating any of the provisions of this ordinance shall, upon conviction thereof, be subject to the penalty provided in Chapter 1.12, Section 1.12.010 of the University City Municipal Code.
