AN ORDINANCE AMENDING CHAPTER 8.28 OF THE UNIVERSITY CITY MUNICIPAL CODE, RELATING TO THE PROPERTY MAINTENANCE CODE, BY REPEALING SUBSECTION PM-112.4.1 OF SECTION 8.28.020 THEREOF, RELATING TO ISSUANCE OF PERMIT, AND ENACTING IN LIEU THEREOF A NEW SUBSECTION TO BE KNOWN AS "PM-II2.4.1 ISSUANCE OF PERMIT," THEREBY AMENDING SUBSECTION PM-112.4.1 SO AS TO REQUIRE THAT ALL TAXES, FEES, ETC., BE PAID BEFORE A PERMIT IS ISSUED; CONTAINING A SAVINGS CLAUSE AND PROVIDING A PENALTY. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, MISSOURI, AS FOLLOWS: Section 1. Chapter 8.28 of the University City Municipal Code, relating to the property maintenance code, is hereby amended by repealing Subsection PM-112.4.1 of Section 8.28.020 thereof, relating to issuance of permits, and by enacting in lieu thereof a new subsection to be known as Subsection "PM-112.4.1 Issuance of permit," so that said subsection, as so amended, shall read as follows: PM-112.4.1 Issuance of permit: If all fees are paid and the code official is satisfied that the premises and its proposed occupation are in compliance with this code and all laws and ordinances applicable thereto, the code official shall issue the permit to occupy as soon as practicable. No permitto occupy shall be issued under the provisions of this code for premises which have been newly constructed, newly altered, or on which a change in use is proposed unless a Certificate of Occupancy has first been issued under the provisions of the building code. No permit or conditional permit to occupy shall be issued under the provisions of this code for premises until all of the following assessments, bills, charges, costs, fees, and taxes have been paid, if due: (1) (2) (3) (4) (5) (6) (7) (8) Real property taxes assessed against the premises. City special tax bills issued against the premises. Neighborhood improvement district special assessments against the premises. Public improvement special assessments against the premises. City refuse service charges for the premises. City nuisance abatement charges for the premises. City weed or trash removal costs for the premises. City planning and development fees for the premises, including building permit fees, electrical permit fees, mechanical permit fees, plumbing permit fees, application fees, inspection fees, and other fees.
