AN ORDINANCE AMENDING CHAPTER 34 OF THE MUNICIPAL CODE OF THE CITY <br />OF UNIVERSITY CITY, RELATING TO ZONING, BY REPEALING SECTI~)N 34-30.5 (2) <br />AND 34-30.5 (3) THEREOF RELATING TO BUILDING HEIGHT AND SETBACK <br />REGULATIONS IN SINGLE FAMILY RESIDENTIAL DISTRICTS, AND ENACTING IN <br />LIEU THEREOF NEW SECTIONS TO BE KNOWN AS "SECTION 34-30.5 (2) AND 34-30.5 <br />(3)/' BY AMENDING SAID SECTIONS SO AS TO OUTLINE SETBACK AND HEIGHT <br />REQUIREMENTS THAT APPLY TO SINGLE-FAMILY DWELLINGS; CONTAINING A <br />SAVINGS CLAUSE AND PROVIDING A PENALTY. <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNWERSITY CITY, MISSOURI, AS <br />FOLLOWS: <br /> <br /> WHEREAS, ai its meeting held at City Hall at 7:30 p.m. on Wednesday September 25, the University City <br />Plan Commission recommended an amendment of Section 34-30.5 (2) and 34-30.5 (3) of the University City Zoning <br />Code by adding provisions to the setback and height requirements for single-family dwellings; and <br /> <br /> WHEREAS, due notice of public hearings to be held by the City Council in the City Council Chambers at <br />City Hall at 7:30 p.m. on October 16, 2002 was duly published in the St. Louis Countian, a newspaper of general <br />circulation within said City; and <br /> <br /> WHEREAS, said public hearings were held at the time and place specified in said notice, and all <br />suggestions or objections concerning said amendment were duly heard and considered by the City Council; <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, <br />MISSOURI, AS FOLLOWS: <br /> <br /> Section 1. Chapter 34 of the Municipal Code of the City of University City, Missouri, relating to <br />zoning is hereby amended by repealing Section 34-30.5 (2) and 34-30.5 (3), relating to Setback and Height <br />Regulations for Single Family Dwellings, and enacting in lieu thereof a new section to be known as "Sections 34- <br />30.5 (2) and 34-30.5 (3)/' by amending said section so as to outline setback and height requirements that apply to <br />single-family dwellings, as so amended shall read as follows: <br /> <br />34-30.5 Density and Dimensional Regulations <br />2. Building Setback Requirements: <br /> <br />Single-Family Detached Dwellings: Except as provided for in Article 5, "Supplementary <br />Regulations," Section 34-55, the following setback requirements shall apply to single- <br />family detached dwellings: <br /> <br />(1) <br /> <br />Minimum Front Yard Setback: 25 feet or if there is no platted building line (per Section <br />34-55.3), the prevailing pattern of front yard setbacks in the subdivision, whichever is <br />greater. In determining the prevailing pattern of a subdivision, the front yard setback of <br />at least ten (10) of the closest lots in the subdivision shall be considered o~, if there are <br />fewer than ten (10) lots, the prevailing pattern of the lots on the block frontage shall be <br />considered. In no case shall any minimum front yard setback be less than twenty-five <br />(25) feet. <br /> <br />34-30.5 Density and Dimensional Regulations <br />3. Building Height Limitations: Except as provided for in Article 5, "Supplementary <br />Regulations," Section 34-54 (height exceptions), no principal building shall exceed three <br />and one-half(3-1/2) stories or thirty-five (35) feet in height, whichever is less. However, <br />if a new structure exceeds the height (as defined in Article 2) of the principal structure <br />on abutting property by more than 15 feet, than the side yard setback along the side in <br />question shall be increased to 8 feet. <br /> <br /> <br />
