AN oRDINANCE AMENDING CHAPTER 10.36 OF THE UNIVERSITY CITY <br /> MUNICIPAL CODE, RELATING TO REGULATIONS FOR SPECIFIC STREETS, BY <br /> ENACTING THEREIN A NEW SECTION TO BE KNOWN AS "SECTION 10.36.131 <br /> CERTAIN COMMERCIAL VEHICLES PROHIBITED ON CERTAIN STREETS - <br /> EXCEPTIONS;" CONTAINING A SAVINGS CLAUSE AND PROVIDING A PENALTY. <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, MISSOURI, AS <br />FOLLOWS: <br /> <br /> Section 1. Chapter 10.36 of the University City Municipal Code, relating to regulations for <br />specific streets, is hereby amended by enacting therein a new section to be known as "Section 10.36.131 <br />Certain commercial vehicles prohibited on certain streets - Exceptions;" which shall read as follows: <br /> <br />Section 10.36.131 Certain commercial vehicles prohibited on certain streets - Exceptions. <br />A. No commercial motor vehicle, except when required to do so for the purpose of collecting <br /> goods or articles in the immediate vicinity, shall be permitted at any time to drive over, <br /> along or upon Sutter Avenue, from Bartmer Avenue to Julian Avenue. <br /> <br />As used in paragraph A, "commercial motor vehicle" means a motor vehicle designed'or <br />used to transport passengers or property if the vehicle has a gross combination weight rating <br />of twenty-six thousand, one (26,001) or more pounds inclusive of a towed unit which has <br />a gross vehicle weight rating often thousand, one (10,001) pounds or more. <br /> <br /> Section 2. This ordinance shall not be construed so as to relieve any person, firm or <br />corporation from any penalty heretofore incurred by the violation of Chapter 10.3 6, nor bar the prosecution <br />for any such violation. <br /> <br /> Section 3. Any person, firm, or corporation violating any of the provisions of this ordinance <br />shall, upon conviction thereof, be subject to the penalty provided in Chapter 1.12, Section 1.12.010 of the <br />University City Municipal Code. <br /> <br /> Section 4. <br />provided by law. <br /> PASSEDthis I'~ dayof .~~ , 2003. <br /> <br />This ordinance shall take effect and be in force from and after its passage as <br /> <br />CERTIFIED TO BE CORR.E~CT AS TO FORM: <br /> <br /> qVv Avromq :V/ <br /> <br /> <br />
