ORDINANCE NO. <br /> <br />AN ORDINANCE AMENDING CHAPTER 2.64 OF THE UNIVERSITY CITY <br />MUNICIPAL CODE, RELATING TO THE NONUNIFORMED EMPLOYEES <br />RETIREMENT SYSTEM, BY REPEALING SECTOIN 2.64.040 THEREOF, <br />RELATING TO MEMBERSHIP, AND ENACTING IN LIEU THEREOF A NEW <br />SECTION TO BE KNOWN AS "SECTION 2.64.040 MEMBERSHIP,"THEREBY <br />AMENDING SAID SECTION SO AS TO EXCLUDE CERTAIN EMPLOYEES <br />FROM MEMBERSHIP IF THEY ELECT TO RECEIVE ADDITIONAL <br />DEFERRED COMPENSATION IN LIEU OF PARTICIPATING IN THE <br />RETIREMENT SYSTEM. <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, <br />MISSOURI, AS FOLLOWS: <br /> <br /> Section 1. Chapter 2.64 of the University City Municipal Code, relating to the non- <br />uniformed employees retirement system, is hereby amended by repealing Section 2.64.040 thereof, <br />relating to membership, and enacting in lieu thereof a new section to be known as "Section <br />2.64.040 Membership" so as to exclude certain employees from membership if they elect to <br />receive additional deferred compensation in lieu of participating in the retirement system; so that <br />said section, as so amended, shall read as follows: <br /> <br />2.64.040 Membership. <br /> <br />All employees of the City, as of the operative date, shall become members on such <br />date. <br /> <br />All other employees, excluding the City Manager, shall become members on the <br />first day of their appointment to work by the City. <br /> <br />Membership ceases on termination of employment by resignation, discharge, death, <br />retirement or for any other reason, or in any event on withdrawal of accumulated <br />contributions. <br /> <br />D. The City Manager shall become a member on July 1, 2001. <br /> <br />An employee holding the position of Assistant/Deputy City Manager, Director of <br />Finance and Community Development, Director of Public Works, Director of <br />Planning and Development, Director of Parks, Recreation and Forestry, or Director <br />of Human Resources shall not become a member if pursuant to an ordinance he or <br />she elects to receive additional deferred compensation under Section 457 of the <br />Internal Revenue Code in lieu of participating in the retirement system. <br /> <br /> Section 2. <br />provided by law. <br /> <br />This ordinance shall take effect and be in force from and after its passage as <br /> <br /> <br />
