Project will contribute to sustaining and expanding the manufacturing businesses located within the County, City and School District and to the creation of new jobs during and after construction which will enhance the economic activity within the County, City and School District resulting in a long term benefit to the City, County and School District. M. NONDISCRIMINATION Developer shall not discriminate on the basis of race, color, creed, national origin, marital status, sex or physical handicap in the lease, sale or occupancy of the Area. N. . MODIFICATIONS OF THIS PLAN Any proposed modification which will substantially change this Plan shall be approved by the City in the same manner as this Plan was first approved. Modifications which will substantially change this Plan include, but are not necessarily limited to; modifications on the use of eminent domain, the length of tax abatement, the boundaries of the Area, or other items which alter the nature or intent of this Plan. This Plan may be otherwise modified (e.g. urban design regulations, development schedule) by the City pursuant to an agreement with the Developer. O. DURATION OF REGULATION AND CONTROLS This Plan shall terminate upon the earlier of: (1) twenty-five (25) years after the City's adoption of the Plan; (2) termination of the Lease or (3) termination or retirement of any bonds issued by the City pursuant to this Plan or a performance agreement. The regulation and controls set forth in this Plan shall be in full force and effect commencing with the effective date of approval of this Plan by Ordinance and ending upon the date the City no longer owns the Project; however, if the City has not acquired the Project prior to January 1,2006, then the regulations and controls set forth in this plan shall end upon January 1, 2006 P. EXHIBITS All attached Exhibits "A" through "_E_" are hereby incorporated by reference into this Plan and made a part hereof. Q. SEVERABILITY The elements of this Plan satisfy all requirements of state and local laws. Should any provisions of this Plan be held invalid by a final determination of a court of law, the remainder of the provisions hereof shall not be affected thereby, and shall remain in full force and effect.
