Project will contribute to sustaining and expanding the manufacturing businesses located within <br />the County, City and School District and to the creation of new jobs during and after <br />construction which will enhance the economic activity within the County, City and School <br />District resulting in a long term benefit to the City, County and School District. <br /> <br />M. NONDISCRIMINATION <br /> <br /> Developer shall not discriminate on the basis of race, color, creed, national origin, marital <br />status, sex or physical handicap in the lease, sale or occupancy of the Area. <br /> <br />N. . MODIFICATIONS OF THIS PLAN <br /> <br /> Any proposed modification which will substantially change this Plan shall be approved <br />by the City in the same manner as this Plan was first approved. Modifications which will <br />substantially change this Plan include, but are not necessarily limited to; modifications on the use <br />of eminent domain, the length of tax abatement, the boundaries of the Area, or other items which <br />alter the nature or intent of this Plan. <br /> <br /> This Plan may be otherwise modified (e.g. urban design regulations, development <br />schedule) by the City pursuant to an agreement with the Developer. <br /> <br />O. DURATION OF REGULATION AND CONTROLS <br /> <br /> This Plan shall terminate upon the earlier of: (1) twenty-five (25) years after the City's <br />adoption of the Plan; (2) termination of the Lease or (3) termination or retirement of any bonds <br />issued by the City pursuant to this Plan or a performance agreement. <br /> <br /> The regulation and controls set forth in this Plan shall be in full force and effect <br />commencing with the effective date of approval of this Plan by Ordinance and ending upon the <br />date the City no longer owns the Project; however, if the City has not acquired the Project prior <br />to January 1,2006, then the regulations and controls set forth in this plan shall end upon January <br />1, 2006 <br /> <br />P. EXHIBITS <br /> <br /> All attached Exhibits "A" through "_E_" are hereby incorporated by reference into this Plan <br />and made a part hereof. <br /> <br />Q. SEVERABILITY <br /> <br /> The elements of this Plan satisfy all requirements of state and local laws. Should any <br />provisions of this Plan be held invalid by a final determination of a court of law, the remainder of <br />the provisions hereof shall not be affected thereby, and shall remain in full force and effect. <br /> <br /> <br />
