BILL NO. ~;~ 0 0 <br /> <br />AN ORDINANCE AMENDING CHAPTER 5.72 OF THE UNWERSITY CITY <br />MUNICIPAL CODE, RELATING TO SELF-SERVICE LAUNDRIES AND DRY <br />CLEANING ESTABLISHMENTS, BY REPEALING SECTION 5.72.020 <br />THEREOF, RELATING TO HOURS WHEN ESTABLISHMENTS MAY BE <br />OPEN, AND ENACTING IN LIEU THEREOF A NEW SECTION TO BE KNOWN <br />AS ASECTION 5.72.020 HOURS WHEN ESTABLISHMENTS MAY BE OPEN," <br />THEREBY AMENDING SAD SECTION SO AS TO AUTHORIZE THE CITY <br />COUNCIL AND CITY MANAGER TO SET EXTENDED HOURS OF <br />OPERATION; CONTAINING A SAVING CLAUSE AND PROVDING A <br />PENALTY. <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, <br />MISSOURI, AS FOLLOWS: <br /> <br /> Section 1. Chapter 5.72 of the University City Municipal Code, relating to self-service <br />laundries and dry cleaning establishments, is hereby amended by repealing Section 5.72.020 thereof, <br />relating to hours when establishments may be open, and enacting in lieu thereofa new section to be <br />known as "Section 5.72.020 Hours when establishments may be open," thereby amending said <br />section so as to authorize the City Council and City Manager to set extended hours of operation; so <br />that said section, as so amended, shall read as follows: <br /> <br />Section 5.72.020 Hours when establishments may be open. <br /> <br />It is unlawful for any laundry or laundromat establishment; as herein defined, to <br />remain open after the hour of 11:59 p.m. or to reopen before 7:00 a.m. of the <br />following day, except that for part or all of a current license year the City Council <br />may authorize a laundry or laundromat establishment to be open during some or all of <br />said prohibited hours if the City Council finds: 1) that such extended hours will not <br />result in noise or litter violations of this code, or create a nuisance; and 2) the laundry <br />or laundromat establishm'ent is at least 100 feet in all directions from any residential <br />lot, or a supporting petition is signed by two-thirds of the residential owners and two- <br />thirds of the residential tenants within 100 feet. <br /> <br />If the City Council has authorized extended hours for a laundry or lauridromat <br />establishment for part or all of a license year, the City Manager may authorize <br />extended hours for that laundry or laundromat establishment for part or all of any <br />subsequent license year provided the City Manager has first made the same findings <br />required of the City Council for the initial year or part thereof. <br /> <br />C. Any extended hours authorized by this section shall be indicated on the license and <br /> shall be permitted only during that license year or part thereof. <br /> <br /> <br />
