AN ORDINANCE VACATING AND SURRENDING THE PUBLIC RIGHT-OF-WAY BEHIND 7831-7853 OLIVE BOULEVARD, BUT RESERVING ANY PUBLIC UTILITY EASEMENTS, AND DIRECTING THAT THIS ORDINANCE BE RECORDED IN THE OFFICE OF THE RECORDER OF DEEDS OF ST. LOUIS COUNTY, MISSOURI. WHEREAS, there is an alley which is a public fight-of-way behind 7831-7853 Olive Boulevard in the Eastover Subdivision in University City, in St. Louis County, Missouri; and WHEREAS, due notice of a publ, jq~?aring, to be held by the City Council in the City Council Chambers at City Hall on ~ o23 ,2004, at 7:30 p.m., to hear any comments conceming the proposed vacation of said right-of-way, was duly publi~l]~e~d,.!n_ !he st. Louis Countian, a newspaper of general circulation within said City, on ~/_5 ,2004; and WHEREAS, said public hearing was held at the time and place specified in said notice, and all comments concerning the vacation of said right-of-way were duly heard and considered by the City Council. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, MISSOURI, AS FOLLOWS: Section 1. The public right-of-way behind 7831-7853 Olive Boulevard in the Eastover Subdivision in University City in St. Louis County, Missouri, and all of the City of University City's right, title and interest thereinis hereby vacated, surrendered and quitclaimed, reserving, however, all public utility easements, if any; said property is more specifically described as follows: The following is a description of an approximate 15-foot wide x 303.3-foot long alley located within the Eastover Subdivision. Eastover is a subdivision located within the City of University City and recorded on Plat Book 17, Page 42 of the records of the St. Louis County Recorder of Deeds. The boundaries of this alley are described as follows: Beginning at a point located 111.375 feet north of the point of intersection of the north right of way of Olive Blvd. (90 feet wide), a Missouri State Highway (Route 340), and the west right of way line of Eastover Ave. (40 feet wide), a residential street in the City of University City, and lying on the west right of way line of the said Eastover Ave. (40 feet wide); then going a distance of 303.375 feet westwardly along a line being the north lot lines of Lot 1, Lot 2, Lot 3, Lot 4, Lot 5, Lot 6, and Lot 7 of Block 2 of the above- described Eastover Subdivision to a point; thence tuming right and going a distance of 15 feet northwardly along a line being the east right of way of Fairview Ave. (40 feet wide) to a point; thence turning left and going a distance of 303.375 feet eastwardly along a line
