AN ORDINANCE AMENDING CHAPTER 6.04 OF THE UNWERSITY <br />CITY MUNICIPAL CODE, RELATING TO ANIMALS GENERALLY, <br />BY REPEALING SECTION 6.04.030 THEREOF, RELATING TO <br />KEEPING MORE THAN TWO ANIMALS UNDER CERTAIN <br />CONDITIONS UNLAWFUL, AND ENACTING IN LIEU THEREOF A <br />NEW SECTION TO BE KNOWN AS "SECTION 6.04.030 KEEPING <br />MORE THAN TWO ANIMALS UNDER CERTAIN CONDITIONS <br />UNLAWFUL," THEREBY AMENDING SAID SECTION SO AS TO <br />REMOVE THE LIMIT ON THE NUMBER OF PET BIRDS WHICH <br />MAY BE KEPT; CONTAINING A SAVINGS CLAUSE AND <br />PROVIDING A PENALTY. <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY <br />CITY, MISSOURI, AS FOLLOWS: <br /> <br /> Section 1. Chapter 6.04 of the University City Municipal Code, relating to <br />animals generally, is hereby amended by repealing Section 6.04.030 thereof, relating to <br />keeping more than two animals under certain conditions unlawful, and enacting in lieu <br />thereof a new section to be known as "Section 6.04.030 Keeping more than two animals <br />under certain conditions unlawful," thereby amending said section so as to remove the <br />limit on the number of pet birds which may be kept; so that said section, as so amended, <br />shall read as follows: <br /> <br /> Section 6.04.030 Keeping more that two animals under certain conditions <br />unlawful. <br /> <br /> It is unlawful for any person to keep, maintain, or allow to remain on any one lot, <br />tract or parcel of ground within the city more than two animals of the following types or <br />any combination thereof: Dogs, cats, monkeys, or ducks as provided for in Section <br />6.04.020; excluding, however, the young of a litter of animals under three months of age; <br />it shall further be unlawful for any person to keep more than one such pet per dwelling <br />unit in multiple-family buildings of three units or more; provided, however, this section <br />shall not apply where such animals are kept in the conduct of a commercial enterprise or <br />business at locations where such a business is permitted and duly licensed under Title 5 <br />of this Code. <br /> <br /> Section 2. This ordinance shall not be construed so as to relieve any person, <br />firm or corporation from any penalty heretofore incurred by the violation of Section <br />6.04.030, nor bar the prosecution for any such violation. <br /> <br /> .Section 3. Any person, firm, or corporation violating any of the provisions of <br />this ordinance shall, upon conviction thereof, be subject to the penalty provided in <br />Chapter 1.12, Section 1.12.010 of the University City Municipal Code. <br /> <br /> <br />
