BILL NO. ~'~iq <br /> <br />AN ORDINANCE AMENDING CHAPTER 34 OF THE MUNICIPAL CODE <br />OF THE CITY OF UNIVERSITY CITY, RELATING TO ZONING, BY <br />REPEALING SECTION 34-61.1 THEREOF RELATING TO FENCE HEIGHT, <br />AND ENACTING IN LIEU THEREOF A NEW SECTION TO BE KNOWN AS <br />"SECTION 34-61.1," BY AMENDING SAID SECTION SO AS TO ALLOW <br />AN EXCEPTION FOR POST HEIGHT; CONTAINING A SAVINGS CLAUSE <br />AND PROVDING A PENALTY. <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, <br />MISSOURI, AS FOLLOWS: <br /> <br /> WHEREAS, at its meeting held at City Hall at 6:30 p.m. on April 28, 2004, the <br />University City Plan Commission recommended an amendment of Section 34-61.1 of the <br />University City Zoning Code by adding provisions that will allow for an exception for.post <br />height; and <br /> <br /> WHEREAS, due notice of public hearings to be held by the City Council in the City <br />Council .Cham. be~all at 7:30 p.m. on f/')~g.~0,, ~tgt./' , was duly published in <br />the ~-~~' , a newspaper of general circulation within said City; and <br /> <br /> WHEREAS, said public hearings were held at the time and place specified in said notice, <br />and all suggestions or objections concerning said amendment were duly heard and considered by <br />the City Council; <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />UNIVERSITY CITY, MISSOURI, AS FOLLOWS: <br /> <br /> Section 1. Chapter 34 of the Municipal Code of the City of University City, Missouri, <br />relating to zoning is hereby amended by repealing Section 34-61.1, relating to fence height, and <br />enacting in lieu thereof a new section to be known as "Section 34-61.1," by amending said <br />section so as to allow an exception for post height, as so amended shall read as follows: <br /> <br />Section 34.61.1 Height limitations. <br /> <br />1. In any residential district or the "HRO" district, no fence located within a <br />required side or rear yard shall exceed six feet in height above grade, except that <br />posts may exceed the limitation by no more than six inches (including decoration <br />and/or ornament at the top of the post), unless otherwise permitted in this article <br />for purposes of screening, or for tennis courts, backstops, or playgrounds.
