BILL NO. O r ANC NO. t',qO AN ORDINANCE APPROVING' AN AGREEMENT WITH THE DEPARTMENT OF THE ARMY FOR THE DESIGN OF THE UNIVERSITY CITY BRANCH OF THE RIVER DES PERES, MISSOURI PROJECT. WHEREAS, the University City Branch of the River Des Peres, Missouri Project (the "Project") is a flood control project in the City of University City, Missouri, commencing at Purdue Avenue at stream mile 0.97, to Kempland Avenue at approximately stream mile 3.5, as generally described in the River Des Peres, Missouri, Feasibility Report, Environmental Assessment and Finding of No Significant Impact, dated June 1988, and approved by the United States Army Chief of Engineers; and WHEREAS, construction or implementation of the Project is authorized by Section 101 (a) (17) of the Water Resources Development Act of 1990; and WHEREAS, the Energy and Water Development Appropriations Act for Fiscal Year 2004, Public Law 108-137, included funds for the United States Department of the Army to initiate design of the Project; and WHEREAS, Section 105(c) of Public Law 99-662 provides that the costs of design of a water resources project shall be cost shared in the same percentage as the purposes of the project; and WHEREAS, the United States Department of the Army and University City agree that University City shall contribute twenty-five percent (25%) of the financial obligations for the design of the Project. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNWERSITY CITY, MISSOURI, AS FOLLOWS: Section 1. The City Manager is authorized and directed to enter into and execute on behalf of the City of University City, Missouri, the "Design Agreement between the Department of the Army and the City of University City, Missouri for the Design of the University City Branch of the River Des Peres, Missouri Project," which is attached hereto, made part hereof, and approved. The City Manager is further authorized to execute'all documents in connection with said Agreement.
